Minutes of the Regular Meeting
Held Tuesday, June 15, 1982
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 750 South
Plaza Drive.
Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The following
members were present: Mayor Lockwood, Councilmembers Hartmann, Losleben,
Mertensotto and Witt.
APPROVAL OF Councilman Losleben moved approval of the minutes of the June
MINUTES lst meeting.
Councilwoman Witt seconded the motion.

CONSENT CALENDAR Councilman Losleben moved approval of the consent calendar as
submitted and recommended for approval as part of the regular
agenda, along with authorization for execution of all necessary
documents contained therein.
1. Acknowledgement of the Treasurer's report for May.
2. Appointment of Dennis Delmont as Civil Defense Coordinator.
3. Acknowledgement of a letter from the Association of Metropolital
Municipalities on annual dues.
4. Acknowledgement of a memo on an assessment formula for
removal of diseased trees and Resolution No. 82-51,
"RESOLUTION ESTABLISHING ASSESSMENT FORMULA FOR REMOVAL OF
DISEASED TREES".
5. Acknowledgement of the Fire Department monthly report for May.
6. Approval of the List of Claims dated June 15, 1982, and
totalling $95,608.90.
7. Approval of the List of Licenses, granting licenses to:

MENDOTA PLAZA Mr. Bill Sheehy was present and showed a scheme of building
IMPROVEMENTS improvements for the Mendota Plaza Shopping Center, including
MGM Liquors. He stated that the proposed improvements would
include repainting a color scheme for the entire center;
painting the rear of the center to match the full color scheme;
enclosing the roof units and trash areas; cleaning up the rear
entrance.and redoing the entry vestibule;,and repairing some of the
ceiling tiles. The corrigated metal facade needs repairing as
it is full of holes from previous signs being taken down. He
noted tht they will do a first class job of building and repair-
ing. Councilman Mertensotto suggested that a game room area
should not be considered in any remaining vacant space.
There was some discussion as to allowing window signs and Sheehy
noted that there was a lack of policing on their part, but that
this will be monitored more closely in the future.
The Council felt that staff should work with Mr. Sheehy on a
developer's agreement and Mr. Sheehy stated that obtaining a
performance bond would be no problem. He noted that MGM
Liquor would be ready to open in 60 to 90 days after the remodel-
ing is complete. Mr. Sheehy distributed a list of proposed
improvements and Councilwoman Witt noted that there should be
an improved lighting system in the common area. Mr. Sheehy
acknowledged that suggestion.
After further discuss-ion, Mr. Sheehy was directed to have
preliminary plans available for City Administrator Johnson to
discuss with the Council at the July 6th meeting, with a com-
pleted developer's agreement ready by the July 20th meeting.
The tentative start-up date for opening MGM Liquor will be
October 15th. This will allow the City time to rescind the
municipal liquor ordinance and adopt an off-sale liquor ordinance.
SURFCO BUILDING Mr. Al Deininger, from Getty Oil and Mr. Bill Richie, were
PERMIT REQUEST present to discuss their proposed remodeling plans for the
Surfco Gas Station at 1960 Dodd Road. The remodeling is to
allow the station to become self-service, and is not intended
to be a convenience store. They noted that the new lighting
to be installed will be less bright that what is there now and
that the light will be cast down, rather than out and around.
Mr. Richie noted that there is a similar station located in
Cannon Falls and one in South St. Paul, if the Council desired
to observe these. It was noted that the original conditional
use permit was granted to Skelly Oil in 1972, to allow the
station to be in operation. Mr. Deininger noted that Skelly
merged with Getty, so technically they are the same owner.
He also noted that the exterior of the building will have
a sand tone painted rough sawn cedar exterior.

Councilman Losleben expressed concern over the new type of
lighting to be installed and also questioned the location of
the new sign. He felt that the Council should address all areas
of the building permit, rather than just one phase of It at
a time.
After further discussion, Mayor Lockwood moved that a building
permit be granted to allow the contractor to finish up what
was started on the interior of the building, per se, except
the lighting and signing, conditioned upon the applicant
agreeing to whatever conditions the City Council shall deem
proper for the operation of the station, the location of the
sign and the lighting and approval of staff.
Councilwoman Witt seconded the motion.

FIRE RELIEF

The motion did not carry and the applicants were advised to
return to the July 6th Council meeting with more details on
the proposed lighting scheme and sign information. Staff
was directed to contact Mr. Deininger to let him know what the
City desires.
Mr. Will Wachtler and several other volunteer firemen were in
the audience to discuss proposed Association by-laws. Mr. Wachtler
noted that two minor corrections in the original draft of the
by-laws had been corrected and therefore was acceptable to
the members. Mr. Wachtler notified the Council that the
By-laws had been executed. Councilman Mertensotto moved that
the Mendota Heights Fire Relief Association By-laws, under
date of June 15, 1982, be ratified on behalf of the governing
body of the City:of Mendota Heights and that a copy of the
By-laws be submitted to the appropriate State Office.
Councilman Hartmann seconded the motion.

MISCELLANEOUS Mayor Lockwood noted that he had received a telephone call from
a woman who had a fence installed on her property at Marie and
Victoria and the subsequent problems with the fence installation.
It was noted that the fence was six feet onto City property and
three feet onto her neighbor's property. Staff is to work out
a solution with the resident.
FIRE DEPT. TANK City Administrator Johnson noted that he had seen the used
TRUCK truck chassis that the fire department in interested in purchas-
ing. He turned the discussion over to Bruce Levine, who was
present in the audience. Mr. Levine explained that the truck
is a 1977 Ford Louisville 8000, which meets most of the spec-
ifications except for a few minor items. It is now at the
Public Works Garage and is a diesel engine, chassis only, no
tank. There are 105,000 miles on the speedometer and there is
little or no rust. Boyer Ford located it for them and the
price would be $12,900. The Council noted that this price was
greater than the original price of $10,000 agreed on by the
Council and Fire Department.

City Administrator Johnson suggested that the City advertise
for bids with and without a trade-in.
MISCELLANEOUS The Council acknowledged receipt of a handout letter from
Norbert Berg, commending Chief Delmont for his professionalism
in dealing with a recent situation.
MISCELLANEOUS City Administrator Johnson read a memo from Chief Delmont relative
to a runaway semi-truck and 82 year old Rollo Ransier, who tried
to stop the truck and received minor bruises. Mayor Lockwood .
noted that any member of the City Council who wished to commend
Mr. Ransier for his action should call him, but that no public
action should be taken.
MISCELLANEOUS The Mayor again noted that Council letters of concern or notes
regarding the Sheehy Mendota Plaza property and proposed
improvements should be directed to City Administrator Johnson and
that they would like to consider a 15 minute tour of the Mendota
Plaza at the next Council meeting, possibly meeting at the
shopping center at 7:15 P.M.
TENNIS COURTS Park and Recreation Commission Chairman Tom Bayless.was present
in the audience and noted that the tennis courts have been
resurfaced and that there were no other matters to discuss.
VAN-LANDSCHOOT There was some discussion on the Van Landschoot case and City
Attorney Winthrop noted that a decision is needed by
September 9th.
After further discussion, Councilman Hartmann moved that the
City Attorney be directed to appeal the court's decision in the
Van Landschoot litigation.
Councilman Losleben seconded the motion.

ELEVATED WATER The Council acknowledged a memo from City.Engineer Kishel
STORAGE outlining the proposed repairs to the elevated water tank.
Mr. Kishel explained how the repairs would be done. The work
will be completed in September, 1982.
ASSESSMENT Engineer Kishel noted that Northland Drive and the DuPont Addition
HEARINGS improvements would be assessed.this year and the possiblilty
that the Pilot Knob Road improvements may not be ready for
assessing until next year. He suggested a tentative date for
final assessment hearings on September 7th.
After discussion, Councilman Losleben moved
that the

MENDOTA INTERCHANGE
The Council acknowledged receipt of a handout

hearing to be conducted by Mn/DOT on June 22
at 7:30
P.M. at
St. Peter's Church in Mendota, regarding the
proposed Mendota
Interchange project. No action was taken.

Councilman Losleben moved the adoption of Resolution No. 82-
51-A, "RESOLUTION ORDERING PREPARATION OF ASSESSMENT ROLLS FOR
NORTHLAND DRIVE/MENDOTA HEIGHTS INDUSTRIAL PARK IMPROVEMENTS
(IMPROVEMENT NO. 81, PROJECT NO. 6), NORTHERN STATES POWER
COMPANY STORM SEWER IMPROVEMENTS (IMPROVEMENT NO. 82, PROJECT NO.
5) AND MICHAEL S. DUPONT ADDITION IMPROVEMENTS (IMPROVEMENT NO.
81 PROJECT NO. 8)".
Councilman Mertensotto seconded the motion.

SPECIAL MEETING Councilman Losleben sketched a proposed plan for the intersection
of TH 110 and TH 149. He briefly explained the discussions he
has had with Mr. Toomey, the owner of the Standard Oil Station
on the corner. He also noted that he had set up a meeting with
Mn/DOT representatives, Wilder representatives and himself,
Administrator Johnson and Planner Dahlgren, for a discussion
on the matter for Monday, June 21st, at 2:30 P.M. He suggested
that other interested Council members might wish to attend.
It was the concensus of the Council to hold an adjourned meeting
at 2:30 P.M. on June 21st to discuss the intersection and related
matters.
CABLE TV Councilman Losleben noted that he, as a representative of the
Cable TV Commission, would be preparing a position paper regarding
Cable TV. He wondered whether he should have an endorsement from
the City Council. It was decided that he would send copies of
his position paper to the other Council members for their reaction
before submitting his paper to the Commission.
ADJOURN There being no further.business to come before the Council,
Councilman Losleben moved that the meeting be adjourned to 2:30 P.M.
on Monday, June 21st.
