1983-01-04 Council minutesPage No. 1764 January 4, 1983 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, January 4, 1983 Pursuant to due call and notice thereof the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Lockwood called the meeting to order at 7:30 P.M. OATH OF OFFICE ROLL CALL APPROVAL OF MINUTES Ayes: 5 Nays: 0 Administrator Johnson administered the Oath of Office to the following Council members who were reelected at the November 2, 1982, General and City election: Mayor Lockwood, Council- man Hartmann, Councilwoman Witt. The following members were present: Mayor Lockwood, Councilmembers Hartmann, Losleben, Mertensotto and Witt. Councilman Hartmann moved approval of thaminutes of the December 21st meeting with corrections. Mayor Lockwood seconded the motion. CONSENT CALENDAR Councilman Losleben moved approval of the consent calendar, as submitted and recommended for approval as part of the regular agenda, along with authorization for the execution of all necessary documents contained therein. 1. AcknoWledgement of a letter from the Metropolitan Council on the proposed mortgage revenue bond. 2. Acknowledgement of•the Code Enforcement monthly report for December. 3. Acknowledgement of memos from the City Administrator advising of Park and Planning Commission'terms due to expire on January 31st. 4. The Council acknowledged and discussed a memo from Police Chief Delmont recommending the acquisition of six Citi-Com Plus radios and installation, from Nelson Radio. The Council noted that the low quotation from Nelson Radio". $2,640, is considerably less than the $8,000 proposed in the C.I.P. After a brief discussion, Councilman Losleben moved to authorize acquisition and installation of six Citi-Com Plus mobile radios from Nelson Radio:.. Company, in accordance with the Police Chief's memo, the acquisition to be funded by Equipment Certificates. Councilman Hartmann seconded the motion. The Council acknowledged a memo from Fire Marshall Gene Lange recommending the acquisition of three Scott Air-Pacs and two extra air tanks from Mid Central Fire for a purchase price_of $2,460. After a brief discussion, Councilman Losleben moved to authorize acquisition of three Scott Air-Pac units and two extra air tanks from Mid Central Fire for their low quotation of $2,460, the acquisition to be funded by Equipment Certificates. Councilwoman Witt seconded the motion. COMMUNICATIONS The Council acknowledged and discussed a letter from the League of Minnesota Cities regarding the Local Government Aid distribution formula and recommending cooperation amongst all local governments to support the unified position on LGA allocations. ACTING MAYOR Ayes: 5 Nays: 0 HEALTH OFFICER Ayes: 5 Nays: 0 Page No. 1766 January 4, 1983 The Council also acknowledged and briefly discussed the proposed League of Minnesota Cities 1983 City Policies. Administrator Johnson advised that the League of Cities has requested that City Councils prioritize the policies and submit their five most important policies in each category to the League. Councilwoman Witt moved that Councilman Charles E. Mertensotto be appointed to serve as Acting Mayor during any absences by Mayor Lockwood in 1983. Councilman Hartmann seconded the motion. Mayor Lockwood moved that Dr. Thaddeus Chao be appointed City Health Officer for 1983. Councilman Mertensotto seconded the motion. OFFICIAL The Council acknowledged receipt of letters from the Dakota County NEWSPAPER Tribune and Sun Newspapers requesting consideration to be designated as the City's legal newspaper for 1983. Mayor Lockwood moved that the Sun Newspapers be designated as the City's official newspaper for 1983. Councilwoman Witt seconded the motion. Ayes: 5 Nays: 0 COMMISSION Mayor Lockwood asked the Councilmembers to make recommendations to APPOINTMENTS him of proposed reappointments or replacements for Commission members whose terms will expire on January 31st. Councilman Mertensotto felt that attendance at meetings by current commission members should be the first criteria for reappointment and that preference should be given to long-term members whose attendance has been exemplary. PLANNING Administrator Johnson reviewed a letter and proposed agreement AGREEMENT between the City and the Metropolitan Council whereby the Metro- politan Council would loan the City $15,000 to assist in the cost of planning services necessary in amending the City's Comprehensive Plan to accommodate airport planning requirements. Mr. Johnson adVised that the loan will be interest free and that the repayment schedule would be $7,500 in December of 1984 and the balance on or before December 1, 1985. Ayes: 5 Nays: 0 After discussion, Councilwoman Witt moved to authorize execution of the loan agreement with the Metropolitan Council. Councilman Mertensotto seconded the motion. It was acknowledged by the Council that the foregoing action does not authorize any expenditure for amendment of the plan at this time. BUDGET/CIP The Council reviewed and discussed the proposed Capital Improvement Program and proposed 1983 budget. Ayes: 5 Nays: 0 MISCELLANEOUS MENDOTA SEWER CABLE COMM UNICATION Ayes: 5 Nays: 0 MISCELLANEOUS Page No. 1767 January 4, 1983 After discussion and review, Councilman Losleben moved the adoption of Resolution No. 83-01, "RESOLUTION ADOPTING 1983 BUDGET DOCUMENT", including the Capital Improvement Program. Councilwoman Witt seconded the motion. The Council reviewed and briefly discussed a letter from the Metropolitan Area Management Association relative to the labor relations subscriber service. Administrator Johnson reviewed the memo and noted that the City's current labor negotiator,. St. Paul Employers Association, is paid the $300 annual retainer plus costs relating to labor negotiations. It was the concensus of the Council that there is no reason to make a change in the present negotiation arrangements. Administrator Johnson advised the Council of several calls he has received from Edie Lancaster of the Dakota County HRA regarding the City of Mendota sewer application to HUD. He advised that HUD will grant $1,000,000 to Mendota for the sewer construction project but that the grant is contingent upon the Waste Control Commission receiving favorable action on its CIP. He advised that the Metropolitan Council will conduct a hearing on January 6th at 2:00 P.M. to consider an amendment to the Water Resources Development Guide to accommodate construction of the sewer system along with acquisition of part of the Mendota Heights trunk system. He advised that Ms Lancaster has requested that an elected Mendota Heights official be present at the meeting to support favorable action by the Metropolitan Council. Mayor Lockwood advised that he will contact the Mayor of Mendota to see if he feels Mendota Heights support at the hearing would be desireable or necessary. Administrator Johnson advised the Council that NDC4 Chairman Dave Zemke has submitted a memo to the mayors of all communities involved in NDC4, asking that the respective City Councils authorize their City Attorneys to review the Commission's Preliminary Franchise Ordinance and attend a meeting to discuss the Ordinance. In response, Councilwoman Witt briefly updated the Council on the Commission activities and advised that any City costs incurred because of the request approval would be reimbursable after franchise award. Councilman Losleben moved to direct the City Attorney to thoroughly review the Preliminary Franchise Ordinance and attend the meeting to be held on January 14th. Councilwoman Witt seconded the motion. The Council acknowledged a handout letter and resolution from Dakota County relative to potential siting of a horse racing facility in the County. PERSONNEL Page No. 1768 January 4, 1983 The Council acknowledged and discussed a =MO and proposed chart of salaries, benefits and mileage for non-union personnel for 1983. Administrator Johnson recommended adoption of the proposed schedule along with a proposed $10 per month increase in the City's contribution for health insurance. He advised the Council that the combination of wage and benefit increases as recommended amounts to a total, overall increase of 6% over 1982. Mayor Lockwood suggested that the benefit package may need to be reconsidered if the bargaining unit;settlements result in greater benefits. Councilman Mertensotto restated his position that all of the increases in the schedule should be limited to a 6% maximum. After discussion, Councilman Losleben moved the approval of the following schedule of salaries for non-union personnel, along with a $120 per month City insurance contribution be adopted. Public Works Supervisor $2,187 per month Public Works Director 2,810 per month Engineering Aide III 1,530 per month Engineering Aide IV 1,955 per month City Engineer 2,740 per month Code Enforcement Officer 2,023 per month Police Sergeant 2,545 per month Detective/Fire Marshall 2,670 per month Police Chief 2,935 per month Police Clerk 966 per month Engineering Secretary 961 per month Accounting Clerk 1,354 per month Receptionist/Secretary 966 per month Administrator Secretary 1,235 per month City Clerk 1,908 per month Administrator 3,634 per month Fire Chief 297 per month Assistant Chief 164 per month Recreation Director 677 per month Councilman Hartmann seconded the motion. Ayes: 4 Nays: 1, Mertensotto The Council reviewed and discussed those portions of the Adminis- trator's memo relating to mileage rates. It was the determination that the current 22(4 per mile rate should not be increased, nor should there be any special rate for "hard miles". The Council reviewed and discussed the Administrator's request that his monthly mileage allotment be included within his salary for 1983. In response to a question from the Council, Administrator Johnson advised that if the request is approved, he will not submit mileage or expense vouchers. Councilman Losleben felt that if the request is approved, the Administrator should be reimbursed for mileage and expenses incurred on behalf of the City. He also felt that the City should get away from the policy of monthly allotments and reimburse expenses through vouchers. Page No. 1769 January 4, 1983 After discussion, Councilwoman Witt moved that the $175 monthly Administrator's mileage allotment be included within his monthly salary with the understanding that no mileage reimbursement requests will be submitted. Ayes: 3; Nays: 2, Mertensotto Hartmann MISCELLANEOUS MSA Ayes: 5 Nays: 0 MAC UTILITIES I-35E WATERMAIN CROSSING The Council noted that the retail sale of slab wood is being conducted on the former DeLisi property on TH13 in violation of the Zoning Ordinance. Staff was directed to notify the parties involved to cease and desist the illegal activity. On the recommendation of the Public Works Director, Mayor Lockwood moved the adoption of Resolution No. 83-02, "RESOLUTION ESTABLISHING A MUNICIPAL STATE AID HIGHWAY", establishing Victoria Road, from Marie Avenue to TH 13, as a Minnesota State Aid Highway. Councilwoman Witt seconded the motion. Public Works Director Danielson explained his memo on proposed improvements to serve the MAC area and other properties, including information on approximate assessment costs. Public Works Director Danielson distributed and reviewed a memo relative to the proposed I-35E/Wagon Wheel Trail watermain crossing project. He reviewed proposed assessment rates, reminding the Council that a feasibility/assessment hearing on the proposed improvement will be held on January 18th. PLEDGED Councilman Losleben moved the adoption of the Pledged_Seeurities SECURITIES as_subtitted by Treasurer Shaughnessy, dated December 31, 1982. Councilman Hartmann seconded the motion. Ayes: 5 Nays: 0 DEPOSITORIES Councilman Hartmann moved the adoption of Resolution No. 83-03, "RESOLUTION ESTABLISHING 1983 CITY DEPOSITORIES OF FUNDS". Mayor Lockwood seconded the motion. Ayes: 5 Nays: 0 ( ) MISCELLANEOUS Councilman Mertensotto advised that the Catholic Services for the Elderly, Inc., is working on a development for the construction of a 180 bed elderly nursing care and 100 unit ambulatory elderly housing facility proposed to be located in West St. Paul. He further advised that while the West St. Paul Council has given its approval and financing has been arranged, approval of a Certificate of Need for the nursing care facility must be granted by the Metropolitan Health Board. He stated that the Board will consider the Need Certificate on January 12th and recommended that the City Council, by Resolution, express its support for the project. C Page No. 1770 January 4, 1983 Councilman Mertensotto moved the adoption of Resolution No. 83-04, "RESOLUTION SUPPORTING CATHOLIC SERVICES FOR THE ELDERLY, INC., NURSING FACILITY PROJECT". Councilman Hartmann seconded the motion. Ayes: 5 Nays: 0 LABOR Mr. Gene Tretter, of the St. Paul Employers Association, and NEGOTIATIONS Administrator Johnson reported to the Council on the status of labor negotiations with the Police Department and its union representatives.
