1983-07-19 Council minutesPage No. 1858 July 19, 1983 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular meeting Held Tuesday, July 19, 1983 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Acting Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Acting Mayor Mertensotto, Councilman Hartmann and Councilwoman Witt. Mayor Lockwood and Councilman Losleben had notified the Council that they would be out of town. APPROVAL OF MINUTES Ayes: 3 Nays: 0 CONSENT CALENDAR Councilman Hartmann moved approval of the minutes of the July 5th meeting. Councilwoman Witt seconded the motion. Councilwoman Witt moved approval of the consent calendar as submitted and recommended for adoption as part of the regular agenda, along with authorization for execution of all necessary documents contained therein. 1. Approval of the issuance of a two day on-sale 3.2 malt beverage license to the St. Peter's Church Annual Father Galtier Days, along with waiver of the license fee. 2. Acknowledgement of the Fire Department and Treasurer's monthly reports for June. 3. Approval of the List of Claims dated July 19, 1983, and total- ling $1,194,707.95. 4. Approval of the issuance of Club Liquor licenses to Somerset Country Club and Mendakota Country Club. 5. Approval of the List of Licenses, granting contractor's licenses to the following: Diversified Masonry Fischer Sand & Aggregate Co. Gilbert Constr. Co., Inc. Junek Excavating Co. Wm. F. Kopp Const. Construction Councilman Hartmann seconded the motion. Masonry License Excavator's License Masonry License Excavator's License General Contractor General Contractor Masonry License General Contractor Gas Piping Heating & A/C License Excavator's License General Contractor Ayes: 3 Nays: 0 MISCELLANEOUS Ayes : 3 Nays : 0 HEARING, CASE 83-01 and 83-02, CULLIGAN Page.N6,1859 July 19, 1983 Acting Mayor Mertensotto informed the Council, that as part of the Grand Opening celebration for the Coast to Coast store in the Mendota Plaza, he was presented with a United States flag as a gift to the City. Acting Mayor Mertensotto moved that the Council express its appreciation to the Mendota Plaza Coast to Coast, for their gift of a United States flag to the City. Councilman Hartmann seconded the motion. Acting Mayor Mertensotto opened the meeting for the purpose of a continued public hearing on an application from Lawrence Culligan for critical area and subdivision approval for the proposed Valley View Oak No. 2 Addition. Mr. Culligan reviewed the history of discussions on his application including discussion at the hearing conducted on May 3rd. Mr. Culligan noted that at the May 3rd meeting, the hearing had been continued so that contact could be made with Mn/DOT relative to the status of the Mendota Interchange project and with the Mendota City officials regarding potential sanitary sewer hookup to the Mendota sewer system when it is completed. Mr. Culligan asked that the hearing be continued to late September or early October so that more definitive information will be available from Mn/DOT and to allow further contact with Mendota regarding the utility connection. Mr. Culligan stated that he is requesting the delay because if the Mendota Interchange project, which would include storm sewer construction affecting his site, is intended for construction, he will wait until the project is completed before requesting approval of the plat. Mendota Mayor Royal Bakke, present in the audience, informed the Council that bids for the Mendota sewer project had been recieved on July 15th and would be considered by the City Council at the second meeting in September. He stated that he had received a copy of Engineer Kishel's report to the Council, along with a letter from Administrator Johnson. He briefly reviewed the memo from Mr. Kishel and expressed concerns over possible surface water damage to properties in Mendota. In response to questions from Mayor Bakke, Engineer Kishel stated that it is anticipated that Mn/DOT construction in the Interchange would begin sometime in 1986 and take until 1989 to complete. He stated that Mn/DOT staff is pushing to get the project into the planning stages. The project would include a large storm sewer project which would pick up water from the highway, from the original Valley View Oak plat, and also from the proposed plat and other areas. Mayor Bakke indicated that cooperation on the utility connection seems to be a good possibility but that Mendota would not support the cost of extension. Acting Mayor Mertensotto suggested that an agreement between the cities should be prepared to provide the permission from Mendota for the seven lots to connect to the utility system at the developer's expense and in return that the City of Mendota Heights will not approve the subdivision until such time as the Mn/DOT storm sewer system is in place. After additional discussion with Mayor Bakke and other Mendota officials, the Council directed the City Engineer to work with the developer and the engineer for the City of Mendota and to appear before the Mendota City Council if necessary. Councilman Hartmann moved to continue the hearing to October 4th. Councilwoman Witt seconded the motion. Discussion on the Leadership Training Seminar summary was tabled. Architect Jann Blesener presented three additional potential schemes for placement of the new fire facility on property across from the existing facility. There was considerable discussion over which potential site the facility should be located on. It was the concensus of the Council to direct the Administrator to contact Mr. Warnke and advise him that the City Council must make a decision to either acquire and develop his parcel or to acquire property to the south and acquire none of his property. The Administrator was further directed to contract an appraisal of one or both potential sites based as he determines necessary after contacting Mr. Warnke. The Council authorized Mrs. Blesener to begin the needs assessment and design criteria phase of the project. Mrs. A. J. Hipp and Mr. Brian Birch were both present relative to discussion on the proposed "downtown" study which occurred at the July 5th meeting. Assistant City Attorney Tom Hart distributed copies of a proposed resolution to approve amendments to the By-laws of the Firemen's Relief Association, along with supporting documents. Staff was directed to study the matter of supplemental insurance and to define what the City's contribution to the retirement plan would be. MENDOTA HEIGHTS The Council acknowledged and discussed a memo from the Public ROAD Works Director recommending construction of a portion of Mendota Ayes: 3 Nays: 0 Ayes: 3 Nays: 0 Ayes : 3 Nays : 0 ADJOURN Ayes : 3 Nays : 0 Page No. 1861 July 19, 1983 Heights Road east of TH 149, along with an eight foot wide bituminous trail, all via MSA funding and constructed by Mn/DOT. He also recommended that the Council authorize preparation of plans for an extension of the City's watermain from Lake Drive along TH 149 and east and west of TH 149 on Mendota Heights Road con- current with the Mendota Heights Road construction. He stated that the watermain extension was addressed as a part of the watermain looping in the water tower and water system project and should be financed via the Water Revenue Fund. Councilwoman Witt moved to authorize staff to proceed with Phase 2 of Mendota Heights Road construction as an MSA project. Councilman Hartmann seconded the motion. Councilman Hartmann moved to direct the Public Works Director to proceed with the bituminous trail proposed utilizing MSA funding. Councilwoman Witt seconded the motion. Councilman Hartmann moved to authorize staff to proceed with plans for construction of the watermain extension as proposed, financing to be via the Water Revenue Fund. Councilwoman Witt seconded the motion. Public Works Director Danielson also informed the Council that Mn/DOT will need wetlands permits in conjunction with 1-494 construction east of TH 149. He advised that Mn/DOT will soon submit plans to the Council for approval and will probably request wetlands permit hearing waivers at that time. There being no further business to come before the Council, Councilman Hartmann moved that the meeting be adjourned. Councilwoman Witt seconded the motion.
