Ordinance No, 7 entitled An Ordinance Granting A Franchise for the Gonstruction and Operation of a Water SystemNithin a Prescribed Area' is hereby (A) Article 111, Section 3,04 thereof is amended so as to read as follows: amended in the following respects: 3.04 The rates to be charged and to remain in effect until changed in accordance with Section 3.06 shall not exceed tbp following: (A)In the event meters are used,a minimum charge of $7.50 per month for first 30,000 gallons of water,or less, used by the consumer, plus • $0,40 per 1,000 gallons or fraction thereof for consumption in exoess (B)Inthe event meters are not used, there shall be a flat charge of of 30,000 gallons per month. $7.50 per month for each single family dwelling and a land area of not more than 20,000 sq. ft. An additional flat charge of 42,00 per month shall be made for water used on each additional one-half acre (C)Inthe event water is furnished to any commercial or industrial or portion thereof. establishment by said Company, the aupply of water furnished to any such establishment shall be metered and the charge thereof shall be a minimum charge of $10.00 per month for the first 30,000 gallons of water or less, used by the consumer, plus $0.40 per 1,000 gallons or fraction thereof for consumption in excess of 30,000 gallons per mon(B) Article V1, Section 6.01 thereof is amended by adding thereto the followingth. : At the end of twenty-five years, unless the Franchise is renewed, the ownership of the water system shall revert to the Village of Mendota Heights and shall be operated by it, Section 2. Grantee shall pay the expense of the official publication of this Ordin,- lance. Such payment shall be due promptly upon its being furnished with a statement thereof. Section 3, This Ordinance shall take effect upon its passage and publication; . provided, that it shall not become effective unless accepted by grantee in mriting not later than thirty days following such publication. Thereupon,on motion of Mayor Edman, seconded by Trustee Horning, The Justice Of The Peace elect, Charles C, Holloway, was appointed to fill Mr. Smith's unexpired term. (Ayes,4; Nays,0). Acting Clerk Sweney then administered the Oath of Office to Mr. Holloway. Upon motion of Trustee Krammer,seconded by Trustee Horning, and carried unana- mously, the following roads in Curley' s Valley View Subdivision which Mr. Kramer reported were up to the engineering standards of the Village, were accepted as Village roads: Mary Adele Avenue, Timmy Street from Marie Adele Avenue to Curley 1---, Avenue,Theresa Street from Mary Adele Avenue To Curley Avenue, Patricia Street from / Mary Adele Avenue to Curley Abenue, William Avenue from Rousse Street to Curley Ave- nue, and that connecting road approximately 175 feet in length between Patricia Street and Lexington Avenue. Upon motion of Trustee Kramer, seconded by Trustee Sweney, and carried unana- mously, the meeting was recessed at 8:30 P.Y. to permit public hearings, in accord- ance with published notices on thr ©© road work petitions. The meeting reoonvened Trustee Horning read a letter dated November 5,1957 from the deputy Commissioner at 920 P.M. of Highways, Mr. Frank D. Marzitelli, concerning InterState Road 4,390 as it affeots tho Village. After discussion, and upon motion by Trustee Horning, seconded b Trustee Sweney, the following resolution was adopted: BE IT RESOLVED: that 1,The general location of I.R. 390 as shown on"line (2)" on map No,4A, and 2. A more detailed location labeled Line A as shown on the 200 foot to the inoh contour map extending north and south of T.H. No.100 is acceptable to the Village Council, Furthermore, that acceptance of the location of I.R. 390 is contingent on the State Highway Department proving the following: A. That major traffic interchanges be provided in both northerly and southerly directions at Highway No.100,Highway No.13, and Highway No. 55 intersections B, That grade seperations be provided at the following intersections: 1. The future extension of Wentworth Avenue, 2. The future extension of Marie Avenue . C. S+fiiently, Jr. ,Acting Clerk, MINUTES OF PUBLIC HEARINGS In aocordance with notices published in aocordance with law,public hearings were held on three items in connection with road work within the Village . These hearings were held on Monday November 25,1957 at 8430R.M. The following members were presents Mayor Edman, Trustees Horning,Sweney, and Krammer. Absents Clerk Stary. (1) Fremont Avenue-- After discussion and' upon motion of Trustee Krammer,seconded by Trustee Horntig, and carried unanamously, it was resolved that Fremont Avenue be blaoktopped on an assessment basis at a cost not to exceed $3.50 per front foot.Also, that the engineering work be completed by Walter Carlson with a view torward requesting bids on this job for completion next spring. (2) Curley Subdivision--A plat,was submitted showing the blaektopping work marked in red pencil. After discussion, and upon motion of Trustee Krammer,seconded by Trustee Horning, and carried unanamously, it was resolved that the peti- tion be approved and that bids be advertised for with a view to completion in the summer of 1958. This will be on an assessment basis of approximately $1.10 per front foot. (3) Tilson Highland Heights-- Trustee Krammer read his letter to the Council dated November 1,1957, in connection with this project. The Village Engineer, Mr. Edward Kishel, has completed an engineering study of this project, and and is of the opinion that the drainage work and the balcktopping can be safely undertaken. The cost on an assessment basis would be approximately 41,65 per front foot. Although the Council was willing to go ahead with this project, and so informed the residents present, it was thought best by the residents and the Council that any definite action be delayed until ttce regular meeting of December 16,1957, to permit the residents to re-study their needs in view of Mr. Krammerts engineering report.
