1957-05-20 Minutes of Mendota Heights Village Council*7 VILLAGE OF MENDOTA HEIGHTS Dakota County Minnesota Regular Meeting The regular meeting of the Mendota Heights Village Council was held at the Village Hall May 20, 1957 at 8:00 p. m. The roll beingcalled, all council members were present. Mr. Bradford, chairman of the Mendota Heights Recreation Com- mittee, informed the Council that the Village could acquire tax forfeited land for recreational purposes. Mr. Oppenheimer was requested to set up proper legal proceedure for acquisition of same. A petition from residents along Freeway Road in regard to numerous dog poisonings in that area was read to the council by Mayor Edman. The prime concern was the possible accidental poisoning of children in the area. The constables were request- ed to confer with the owners of the poisoned dogs and to report back to the council at the next meeting. On motion of Trustee Horning, seconded by Trustee Sweney, it was esolved that the minutes of the previous meeting be correct- ed by deleting therefrom a sentence reading as follows, "The Village Attorney stated that the procedure followedwas legal and that the above mentioned property is legally commercial property,"and insert in lieu thereof the following The Village Attorney reported that it was impossible to reach a,conclusion on the basis of facts known and that a search of the Township' repords would be needed," and be it further resolved that the reading of the minutes of said meeting, as corrected, be dis- pensed with and that the same be approved as corrected. Ayes: -5; Nays: O. Several letters were referred to the Council by Mayor Edman in regard to the draining of the Friendly Hills swamp. Mayor Edman informed the writers of these letters that steps were being taken to determine6the owners of the swamp and to deter- mine what steps could be taken to alleviate the situation. Mr. Wallace Carlson reported that he has started his survey of the drainage problem of the Chippewa Avenue area; However, in as much as the survey is notcomplete, it was decided to post- pone any action, until the survey was completed. On motion of Trustee Krammer, seconded by Clerk Stary, it was Fbsolved that Lilac Lane, Viciki Lane, Caron Road, from Victoria Road to Lilac Lane, and Douglas Road from Victoria Road to Lilac Lane, all in the Tilsen Highland Heights addition be accepted as Village roads after certain additional improvements are completed, which work is to be done on or before July 1, 1957 and that the platters be informed of the necessary im- provements by Trustee Krammer. Ayes:-5; Nays: O. 4 Page Two On motion of Trustee Krammer, seconded by Trustee Sweney, it was Resolved that a public hearing be held in regard to the proposed backtopping of roads in the curley Valley View Addition, and the Tilsen Highland Heights Addition. The date set for the hearing was June 17, 1957 at 8:00 p.m. Ayes: -5; Nays: O. Trustee Krammer reports that the Village roads are now in the process of being graded and graveled, and that the area around Village Hall is being blacktopped., and that the area around the Hall. will soon be landscaped. The village attorney was requested to determine whether or not the Council can legally amend the Village Building Code. Mayor Edman requested that Trustee Horning and the Planning Commission review the Building Code and licensing practices in view of the fact contractors working in the area are licens- ed in West St. Paul, St. Paul, Minneapolis, and South St. Paul. On motion of Trustee Horning, seconded by Trustee Kramer, it was Resolved that building permits be issued to Paul Kressin for lots 12 through 17, Block B in the Rogers Lake Addition. Ayes:-5; Nays: 0-. On motion of Trustee Horning, seconded by Trustee Krammer, it was Resolved that Lloyd Tyner be issued a building permit to erect a garage less than 30 feet from Sunset Lane when he has met all of the other necessary requirements. Ayes:-5; Nays: O. On motion of Trustee Horning, seconded by Trutee Sweney, it was Resolved that a building permit to Mr. Claude Anderson, 909 Delaware Avenue, to erect a garage one foot from the pro- perty line be denied. Ayes:-5; Nays:-0. Trustee Horning reported that the Land use map is now in the hands of. the Planning Commission and that as soon as the Highway Department decides where the new highway will be located, the may will be completed. Mr. Ledegar called the Council's attention to the fact that several road restriction violations are occuring. These vio- lations are to be checked by Trustees Sweney and Krammer. A meeting with the West St. Paul City Council was tenatively set for May 27, 1957, 8:00 p.m. The State Sanitary Board informed the Village that the Rabies quarentine has expired. The Mayor requested that Village Attorney, Jim Oppenheimer, and Mr. Clark get together and ar- range a one year lease on the Pilot Knob School. Page Three On motion of Mayor Edman, seconded by Trustee Krammer, it was Resolved that the Clerk be authorized tphave copies printed of all existing and future Ordinances and other legal documents. Ayes:-5; Nays:-0. Mayor Edman informed the Council that the Northern States Power Company is willing to negotiate with the Village for the pos- sible acquisition of property along Highway 13. On motion of Tpustee Horning, seconded by Trustee Kramer, it was Resolvedthat two members of the Council be authorized to attend the League of Minnesota Municipalities Convention at Duluth June. 12, 1957. Ayes:-5; Nays:-0. On motion of Trustee Krammer, seconded by Clerk Stary, it was Resolved that beer licenses be issued to the following; Mrs. Giles Fitch, Mendakota Country Club, Somerset Country Club, Georges Driving Range, River Road Club, and Fischersla Store. Ayes:-5;.Nays:-0. On motion of TI-ustee Horning, seconded by Clerk Stary, it was Resolved that,a special census 'of the Village of Mendota Heights be taken and that Village Attorney Oppenheimer be auth- orized to follow through on this and that the Village Clerk send the Census bureau a check in the amount of $510.00. Ayes:- 5; Nays:-0. The extension of the services of the Mendota Water Company facilities to the Franzmeier and the Kressin property was defer- ed until the next meeting. On motion of Mayor Edman, seconded by Trustee Horning, i6 was Resolved that preliminary approval is hereby given to the pro posed sale of the water system, nowowned and operated by the Mendota Water Company to the proposed Friendly Hills Cooperative Association, Incorporated, provided, however, that before an Ordinance conerning due said transfer is presented to this Council it be informed and advised on such matters regarding the proposed Co-operative Association and the proposed sale as the Mayor may reasonably require. Ayes:-5; Nays:-0. The Application from Mr. Zwach on Wachtler Avenue to erect a structure closer than 30 feet to the street was referred to the Planning Commission. A special permit to Bob LeMay on Rogers Road to erect a pony shed was referred to the Planning Commission. Building Inspector, Richard Bjorklund was requested to contact Village Attorney Jim Oppenheimer in regard to an alleged viola-t tion in the Curley Valley View Addition involving the illegal moving of a building. 9;, Page Four A request to change the name of Fink Drive to Franzmeier Drive in the Rogers Lake Addition was denied.
