RESOLUTION 05 -57
A RESOLUTION APPROVING A WETLANDS PERMIT
FOR A NEW HOME AT 2540 ARBOR COURT
WHEREAS, David Olsen have applied for a Wetlands Permit for a New Home at
2540 Arbor Court [Mendota Woods Lot 7 Block 1, PIN =27- 48460 - 070 -01] as proposed
in Planning Case #05 -30; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 26, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Wetlands Permit for a New Home as presented to the Planning Commission
on the evening of July 26, 2005 and as shown in Planning Case #05 -30;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Wetlands Permit for a New Horne for 2540 Arbor Court
as proposed in Planning Case #05 -30 is hereby approved on the following conditions:
1. The driveway shall be paved in accordance with City regulations.
2. The applicant shall eliminate driveway grades greater than eight percent to the
extent possible.
3. The applicant shall eliminate the culvert shown on plans submitted.
4. The applicant shall install a silt fence on the north side of the driveway during
construction to protect the wetland.
5. The new home shall be properly insulated for aircraft noise as required by the
City's Aircraft Noise Attenuation Ordinance.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The improvements appear to comply with the intent and the regulations of the
Wetlands Ordinance.
2. The proposed plantings in the area of the wetlands will help mitigate potential
water quality issues and will filter runoff into the wetland.
BE IT FURTHER RESOLVED that the Wetlands Permit for a New Home for
2540 Arbor Court as proposed in Planning Case #05-30 under the above conditions
would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
