RESOLUTION 05 -59
A RESOLUTION APPROVING
A PUD PRELIMINARY DEVELOPMENT PLAN
FOR AN OFFICE DEVELOPMENT
AT NORTHEAST QUADRANT OF 494 AND 35E
WHEREAS, Mr. Todd Mohagen has applied for a PUD Preliminary
Development Plan for an Office Development at Northeast Quadrant of 494 and 35E
[That part of the West 1/2 of the Southwest 1/4 of Section 35, Township 28 North Range 23
West, Dakota County MN which lies Southerly of the Southerly line of Mendota Heights
Road and Northeasterly of the Northeasterly line of Trunk Highway No. 35E ad 494 as
said lines are delineated by MN Dept of Transportation Right of Way Plat No. 19 -42]] as
proposed in Planning Case #05 -04; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on February 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the PUD Preliminary Development Plan, Preliminary Plat, and Variance for an
Office Development as presented to the Planning Commission on the evening of
February 22, 2005 and as shown in Planning Case #05 -04,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a PUD Preliminary Development Plan, Preliminary Plat,
and Variance for an Office Development for Northeast Quadrant of 494 and 35E as
proposed in Planning Case #05 -04 is hereby approved on the following conditions:
1. The applicant shall upgrade the building materials to consist of brick and /or
stone on all facades, eliminating the residential -style lap siding as shown.
2. The applicant shall increase landscaping with trees along the east boundary
line, and both trees and shrubs along the rear building line.
3. The applicant shall change the location of the monument sign to meet a 30-
foot setback.
4. The applicant shall provide information relating to building signage.
5. The plans shall meet with the approval of the City Engineer in regard to
Grading, Drainage and Stormwater, Utilities, and other engineering issues.
6. The applicant shall submit revised Preliminary Development PUD plans
■ reflecting the approved conditions.
7. The Fire Chief shall review and approve the location of all fire hydrants.
8. The development shall have an address on Mendota Heights Road. This
address shall be displayed on the monument sign facing Mendota Heights
Road.
9. The Fire Chief shall review and approve the turning radii for emergency
vehicles (Truck turning radius is 38' with a minimum width of 20'.)
10. The Fire Chief shall review and approve the driveway for the project, which
shall be at least 26' wide.
11. All buildings shall be fully sprinklered.
12. The developer and the City shall enter into a Development Agreement. No
final approvals shall be granted until said development agreement is executed.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
1. The project is zoned B-1A, and guided LB-PUD, supporting the use of the
PUD process on this site.
2. The project, with the addition of brick and/or stone on all four building walls,
and the minimal architectural use of lap siding, meets the City's expectation
for commercial PUD development.
3. The project landscaping meets the City's expectation for commercial PUD
development.
4. The project meets the City's expectation for commercial PUD development.
BE IT FURTHER RESOLVED that the PUD Preliminary Development Plan,
Preliminary Plat, and Variance for an Office Development for Northeast Quadrant of 494
and 35E as proposed in Planning Case #05-04 would not have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding
land, and would not be adverse to the general purpose and intent of the Zoning
Ordinance.
