Res 2005- 71 Approving CUP @ 1040 Douglas RdCITY OF MENDOTA HEIGHTS 1 DAKOTA COUNTY, MINNESOTA RESOLUTION 05-11 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE AT 1040 DOUGLASS ROAD WHEREAS, Gary Petrangelo have applied for a Conditional Use Permit for an Accessory Structure at 1040 Douglass Road [Tilsen's Highland Heights Plat 3, Lot 5 Block 2, PIN=27-76402-050-02] as proposed in Planning Case #05-34; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 23, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for an Accessory Structure as presented to the Planning Commission on the evening of August 23, 2005 and as shown in Planning Case #05-34; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for an Accessory Structure for 1040 Douglass Road as proposed in Planning Case #05-34 is hereby approved on the following condition: 1. The accessory structure shall match the existing playhouse in color. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The building is small and will be partially screened from neighboring property. 2. Under the conditions listed in this Resolution, the building would be consistent with other buildings on the property. 3. The proposed building will not crowd other buildings on the site, nor will it create crowding for neighboring property. BE IT FURTHER RESOLVED that the Conditional Use Permit for an Accessory Structure for 1040 Douglass Road as proposed in Planning Case #05-34 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
