Res 2005- 74 Approving Wetlands Permit @ 2101 Lexington AveCITY OF MENDOTA HEIGHTS. DAKOTA COUNTY, MINNESOTA RESOLUTION 05- 74 A RESOLUTION APPROVING A WETLANDS PERMIT TO ALLOW GRADING/FILLING WITHIN 100 FEET OF THE WETLAND SETBACK AREA AT 2101 LEXINGTON AVENUE WHEREAS, Dave Kemp, on behalf of The Catholic Cemeteries has applied for a Wetlands Permit to Encroach into the Wetlands Setback Area for Accommodation of Additional Family Monuments at 2101 Lexington Avenue in Resurrection Cemetery [P1N# 27-04100-010-41] as proposed in Planning Case #05 -40; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 23, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Pelmit to Encroach into the Wetlands Setback Area for Accommodation of Additional Family Monuments at 2101 Lexington Avenue in Resurrection Cemetery as presented to the Planning Commission on the evening of August 23, 2005 and as shown in Planning Case #05 -40; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit to Encroach into the Wetlands Setback Area for Accommodation of Additional Family Monuments at 2101 Lexington Avenue in Resurrection Cemetery as proposed in Planning Case #05 -40 is hereby approved on the following condition: The applicant shall not remove any additional vegetation within the wetland buffer. 2. The applicant shall maintain erosion control measures until vegetation on the disturbed slope is established. 3. The applicant shall provide for a natural planting buffer to filter stonnwater before it enters the lake. BE IT FURTHER RESOLVED that the Wetlands Permit to Encroach into the Wetlands Setback Area for Accommodation of Additional Family Monuments at 2101 Lexington Avenue in Resurrection Cemetery as proposed in Planning Case #05 -40 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
