Res 2005- 86 Approving Lot Split @700 Wesley AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05-86 A RESOLUTION APPROVING A LOT SPLIT TO CREATE ONE ADDITIONAL LOT AT 700 WESLEY LANE WHEREAS, Saint Paul's United Methodist Church have applied for a Lot Split to Create One Additional Lot at 700 Wesley Lane [Lot 6, Block 1, Rolling Woods Second Addition, PID # 27-64751-060-01] as proposed in Planning Case #05-34; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 23, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Lot Split to Create One Additional Lot as presented to the Planning Commission on the evening of August 23, 2005 and as shown in Planning Case #05-34; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Lot Split to Create One Additional Lot for 700 Wesley Lane as proposed in Planning Case #05-34 is hereby approved on the following conditions: The subdivision approval is based upon on sanctuary capacity of no more than 270 seats. If the Church adds services, adequate time shall be allowed between services to clear the parking area to avoid overlapping demand. 2. Trees within 15 feet of the easternmost lot line of the new lot shall be preserved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed lot split creates two lots, both of which comply with the City's dimensional requirements for R-1, Single Family lots. 2. A single family house that conforms to all zoning regulations can be constructed on the new lot without the need for variances. 3. The applicant has made the representation that the land to be subdivided will not be needed for additional parking in the future, and also has acknowledged that the Church understands that it has no reasonable expectation of being granted a variance in the future from the City's parking requirements. BE IT FURTHER RESOLVED that the Lot Split to Create One Additional Lot for 700 Wesley Lane as proposed in Planning Case #05-34 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
