RESOLUTION 2013-92
RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR WIRELESS
ANTENNA MODIFICATION AT 1897 DELAWARE AVENUE
WHEREAS, Willin Consultants, on behalf of Sprint and Independent School District
#197, has applied for a conditional use permit for wireless antenna modification located at
Henry Sibley High School, 1897 Delaware Avenue [PID 27-2500-030-10, SECTION 25
TOWNSHIP 28 RANGE 23, SE 1/4 OF NE 1/4 LESS HGWY 98/100 A EX PT FOR ST SUBJ
TO CO R/W PAR 1(352)] as proposed in Planning Case 2013-18; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing on this
application at their regular meeting on October 22, 2013; and
WHEREAS, the Planning Commission recommended that the City Council approve the
conditional use permit as shown in Planning Case 2013-18.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that
a conditional use permit as proposed in Planning Case 2013-18 is hereby approved with the
following finding of fact:
1. The proposed antenna and accessory equipment modifications meet all of the zoning
ordinance requirements and are consistent with the intent of the Conditional Use Permit
criteria allowing such features.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a
Conditional Use Permit as proposed in Planning Case 2012-18 is hereby approved with the
following conditions:
1. The existing equipment (to be replaced) shall be removed within six months of operational
migration to new equipment. Antenna and equipment removal shall include the removal of
unused mounting equipment and the repair of any damaged wall or roof elements (from
equipment anchors). The city must be notified of the time at which the old equipment is no
longer operational. A bond must be provided to the city according to ordinance
requirements.
2. The new antennas and accessory equipment cabinets shall be painted to match the color of
the building.
3. The new antennas and related equipment shall comply with all FCC regulations.
4. The new antennas and related equipment shall comply with all applicable building and
electrical codes.
5. A lease agreement exists between the applicants and the School District.
6. Any applicable federal, state, or local licenses must be submitted to the council prior to
receiving a building permit.
