Res 2005- 90 Approving CUP @ 600 Valley AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -90 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND SETBACK VARIANCES FOR A REPLACEMENT DETACHED GARAGE AND DRIVEWAY AT 600 VALLEY LANE WHEREAS, Troy Buege has applied for a Conditional Use Permit and Setback Variances for a Replacement Detached Garage and Driveway at 600 Valley Lane [Lot Three (3) Block Four (4), Kirchner Addition, Dakota County, Minnesota, PIN Number = 274 210 003 004] as proposed in Planning Case #05 -43; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 27, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit and Setback Variances for a Replacement Detached Garage and Driveway as presented to the Planning Commission on the evening of September 27, 2005 and as shown in Planning Case #05 -43; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the - City of Mendota Heights that a Conditional Use Permit and Seven -Foot Setback Variance for a Replacement Detached Garage and a Setback Variance for a Driveway for 600 Valley Lane as proposed in Planning Case #05 -43 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed garage meets the requirements for detached garage size. 2. The property is served by a joint driveway that straddles the applicant's lot line. 3. The property is smaller than the City's standard single family lot size. 4. Detached garages are common in the neighborhood. 5. Moving the garage to meet the 10 foot setback would make it inaccessible due to the location of the existing house. 6. Redesigning the driveway to meet the 5 foot setback is not possible due to the location of the existing house. 7. The variances are necessary in order to put the property to reasonable use. 8. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the requested variances. 9. Approval of the requested variances will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the Conditional Use Permit and Setback Variances for a Replacement Detached Garage and Driveway for 600 Valley Lane as proposed in Planning Case #05-43 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
