RESOLUTION 05- 97
A RESOLUTION APPROVING A CRITICAL AREA PERMIT
FOR MODIFICATIONS TO AN EXISTING VACANT HOUSE
AT 1405 SIBLEY MEMORIAL HIGHWAY
WHEREAS, Chuck Hall has applied for a Critical Area Permit For Modifications
to an Existing Vacant House at 1405 Sibley Memorial Highway [PID #27- 04000 - 020 -02
& PID# 27- 04000 - 010 -02] as proposed in Planning Case #05 -52; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on September 27, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Critical Area Permit For Modifications to an Existing Vacant House as
presented to the Planning Commission on the evening of September 27, 2005 and as
shown in Planning Case #05 -52;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Critical Area Permit for Modifications to an Existing
j ) Vacant House for 1405 Sibley Memorial Highway as proposed in Planning Case #05 -52
is hereby approved on the following condition:
1. The Certificate of Occupancy for use of the building shall be withheld until Saint
Peter's Church has received all other relevant planning approvals, specifically the
Preliminary and Final Plat, the Conditional Use Permit, and the Variance.
2. St. Peters Catholic Church shall send a letter to the City of Mendota Heights
acknowledging the inability of the Fire Department to provide fire protection to
this building because of inadequate water supplies, inadequate road access, and no
fire truck turn- around.
3. The Insurance carrier for St. Peters Catholic Church shall send a letter to the City
of Mendota Heights acknowledging the inability of the Fire Department to
provide fire protection to this building because of inadequate water supplies,
inadequate road access, and no fire truck turn- around.
4. This building shall only be used for storage purposes and not for any other
purpose including office space or residence.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
1. The accessory building use is low impact on surrounding land uses and on the
landscape.
2. The proposed use does not increase impervious surface coverage in the area.
3. Vehicular traffic to the building will be minimal.
4. Alternative uses for the building are limited.
BE IT FURTHER RESOLVED that the Critical Area Permit For Modifications
to an Existing Vacant House for 1405 Sibley Memorial Highway as proposed in Planning
Case #05 -52 under the above conditions would not have an adverse impact on the health,
safety, and general welfare of the citizens of the conununity and the surrounding land,
and would not be adverse to the general purpose and intent of the Zoning Ordinance.
