Res 2005-105 Authorizing Grant Agreement for Pilot KnobCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 05 -105 RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE THREE GRANT AGREEMENTS WITH THE STATE OF MINNESOTA FOR THE PILOT KNOB ACQUISITION WHEREAS, Dakota County on behalf of the City of Mendota Heights applied for Natural and Scenic Area, Remediation Fund, and Metro Greenways grants from the Minnesota Department of Natural Resources; and WHEREAS, a Natural and Scenic Area Grant in the amount of $300,000 has been recommended for funding, a Remediation Fund Grant in the amount of $500,000 has been recommended for funding, and a Metro Greenways Grant in the amount of $250,000 has been recommended for finding; and WHEREAS, upon receipt of a resolution approved by the City Council, the Minnesota Department of Natural Resources will finalize grant agreements for the three grants. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, that the City of Mendota Heights act as legal sponsor for the Pilot Knob Acquisition as contained in the Natural and Scenic Area Grant Program Application, Remediation Fund Application and the Metro Greenways Application; and BE IT FURTHER RESOLVED that the City of Mendota Heights has the legal authority to apply for financial assistance and financial capability to meet the match requirement and ensure adequate management and protection; and BE IT FURTHER RESOLVED that the City of Mendota Heights has not entered into a written purchase agreement to acquire the property described in the applications; and BE IT FURTHER RESOLVED that upon approval of its applications by the state, the City of Mendota Heights may enter into an agreement with the State of Minnesota for the above - referenced projects, and that the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreements including dedicating the property located at 2041 Pilot Knob Road for natural open space uses into perpetuity; and BE IT FURTHER RESOLVED that the City Administrator is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.
