Res 2005-107 Purchase Agreement for Pilot Knob AquisitionCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 05 -107 RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO A PURCHASE AGREEMENT FOR THE PILOT KNOB ACQUISITION WHEREAS, the Trust for Public Land (TPL) has acquired an option for the 8.4± -acre Pilot Knob site located at 2041 Pilot Knob Road and has requested that the City of Mendota Heights acquire the property; and WHEREAS, Dakota County and TPL have secured public and private grant fields to purchase the 8.4 ±- acre Pilot Knob site; and WHEREAS, the City of Mendota Heights has completed a Natural Resource Management Plan (NRMP) with help from Great River Greening dated October 18, 2005 as a requirement for the grants; and WHEREAS, at the October 18, 2005 City Council meeting the Council held a Public Hearing to obtain public input on acceptance of the grants for the acquisition of Pilot Knob and implementation of the NRMP. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, that the City of Mendota Heights authorize expenditure of no more than $400,000 from the Budget Reserve fund for the closing and acquisition of the 8.4± -acre Pilot Knob site; and BE IT FURTHER RESOLVED that the City agrees to implement only those restorative and maintenance activities as outlined in the Natural Resource Management Plan with help from Great River Greening dated October 18, 2005; and BE IT FURTHER RESOLVED that the City shall cooperate, but not be required to expend public fiends nor commit City staff resources to the TPL, which shall obtain the grants promised, work with the grant agencies to secure grant agreements, negotiate with grant agencies on post grant acceptance requirements of the City, and undertake the majority of the work to obtain reimbursement for the City of the grant fiends ; and BE IT FURTHER RESOLVED that the City Administrator is authorized to enter into a purchase agreement with TPL, after review and approval by the City Attorney, for the acquisition of the 8.4-±-acre Pilot Knob site.
