Res 2005-108 Approving Wetlands Permit @ 625 Hidden Creek TrlCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -108': A RESOLUTION APPROVING A WETLANDS PERMIT FOR A FIVE -FOOT HIGH ORNAMENTAL ALUMINUM FENCE AT A MINIMUM DISTANCE OF 30 FEET FROM THE WETLAND AT 625 HIDDEN CREEK TRAIL WHEREAS, Chuck and Nancy Reich have applied for a Wetlands Permit for a Five - Foot High Ornamental Aluminum Fence at a Minimum Distance of 30 feet From the Wetland at 625 Hidden Creek Trail [Lot 9, Block 1, Hidden Creek Estates, Dakota County, Minnesota] as proposed in Planning Case #05 -55; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 25, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for a Five -Foot High Ornamental Aluminum Fence at a Minimum Distance of 30 feet From the Wetland as presented to the Planning Commission on the evening of October 25, 2005 and as shown in Planning Case #05 -55; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for a Five -Foot High Ornamental Aluminum Fence at a Minimum Distance of 30 feet From the Wetland for 625 Hidden Creek Trail as proposed in Planning Case #05 -55 is hereby approved under the following condition: 1. This Wetlands Permit shall be subject to the review and approval of the City Engineer. 2. The Five -Foot High Ornamental Aluminum Fence at a Minimum Distance of 30 feet From the Wetland shall not be placed within the Conservation Easement. BE IT FURTHER .RESOLVED that the Wetlands Permit for a Five -Foot High Ornamental Aluminum Fence at a Minimum Distance of 30 feet From the Wetland for 625 Hidden Creek Trail as proposed in Planning Case #05 -55 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
