Res 2005-124 Approving Critical Area Permit @1666 Mayfield Hgts RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -124 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A 280 SQUARE FOOT DECK, CONCRETE STEPS, AND CONCRETE SIDEWALK AT 1666 MAYFIELD HEIGHTS ROAD WHEREAS, Ronald Buelow have applied for a Critical Area Permit for a 280 Square Foot Deck, Concrete Steps, and Concrete Sidewalk at 1666 Mayfield Heights Road [Section 23 Twn 28 Range 23 pt of govt lot 5 com int E line Mayfield Heights Rd & S line Mayfield Heights Lane E on S line lane 219.58 ft to W line L -7 Mayfield Heights S on W line 125.59 ft W parr S Line 231.87 ft to E line Rd N on E line Rd 125 ft to beg Pt of NW Quarter of SW Quarter com 466 ft N& 200 ft W f SE Cor N 125 ft W 231 ft S 125 ft E 231 ft to beg (PID #27- 02300 -093- 52)] as proposed in Planning Case #05 -58; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 22, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit for a 280 Square Foot Deck, Concrete Steps, and Concrete Sidewalk as presented to the Planning Commission on the evening of November 22, 2005 and as shown in Planning Case #05 -58; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Critical Area Permit for a 280 Square Foot Deck, Concrete Steps, and Concrete Sidewalk for 1666 Mayfield Heights Road as proposed in Planning Case #05 -58 is hereby approved on the following condition: 1. The City Engineer shall review the Deck, Concrete Steps, and Concrete Sidewalk for the following: Grading, Drainage, and Conformance to the Critical Area Requirements. The City Engineer shall approve the Deck, Concrete Steps, and Concrete Sidewalk prior to issuance of any building permits. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed Deck, Concrete Steps, and Concrete Sidewalk do not affect the bluffline of the Mississippi River Critical Area. 2. The proposed building expansion is screened by existing vegetation from full view of the River. 3. The proposed building expansion is designed to use natural materials, and will not cause a visual conflict with the goals and objectives of the Critical Area Ordinance. 4. The proposed building expansion meets all other applicable zoning regulations for the R -1 zoning district and the Critical Area Ordinance. BE IT FURTHER RESOLVED that the Critical Area Permit for a Deck, Concrete Steps, and Concrete Sidewalk for 1666 Mayfield Heights Road as proposed in Planning Case #05 -58 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
