Res 2005-126 Approving Wetlands Permit @ 815 Hazel CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05-126 A RESOLUTION APPROVING A WETLANDS PERMIT FOR LANDSCAPING AND GRADING AT 815 HAZEL COURT WHEREAS, James P. Losleben have applied for a Wetlands Permit for Landscaping and Grading at 815 Hazel Court [Lot 3, Block 1, Simek Rearrangement (PID #27- 68300 - 030 -01)] as proposed in Planning Case #05 -60; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 22, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for Landscaping and Grading as presented to the Planning Commission on the evening of November 22, 2005 and as shown in Planning Case #05 -60; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for Landscaping and Grading for 815 Hazel Court as proposed in Planning Case #05 -60 is hereby approved on the following condition: 1. The applicant shall verify that the area directly adjacent to the wetland is not planted with lawn grasses. This area shall remain planted with natural vegetation to provide a filter that prevents grass clippings and fertilizer runoff directly into the wetland. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed project meets the intent of the Wetlands Ordinance. 2. The improvements are primarily landscaping and grading which involve minimal areas of impervious surface. Erosion should be minimized due to the grading proposed. Conditions of the permit, including natural vegetation adjacent to the wetland area, will ensure that no negative water quality impacts on the wetland will occur. BE IT FURTHER RESOLVED that the Wetlands Permit for Landscaping and Grading for 815 Hazel Court as proposed in Planning Case #05 -60 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
