Res 2005-127 Approving Variance @ 589 Emerson AvenueCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05- 127 A RESOLUTION APPROVING A FRONT YARD SETBACK VARIANCE FOR A HOME ADDITION AT 589 EMERSON AVENUE WEST WHEREAS, Peter F. Jackson have applied for a Front Yard Setback Variance for a Home Addition at 589 Emerson Avenue West [Lot 1 Block 18 Somerset View (PID #27- 71150- 010 -18)] as proposed in Planning Case #05 -61; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 22, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Front Yard Setback Variance for a Home Addition as presented to the Planning Commission on the evening of November 22, 2005 and as shown in Planning Case #05 -61; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Front Yard Setback Variance for a Home Addition for 589 Emerson Avenue West as proposed in Planning Case #05 -61 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The Mendota Heights Zoning Ordinance states that a front yard abutting a street shall not be less than thirty feet in width. 2. Grading and gutter installation would appear to the most common solution to resolve existing drainage problems, without need for a setback variance. 3. There is no denial of a reasonable use of this property in its current state without the addition. 4. An addition can be constructed on this property in a conforming location or at a conforming size. BE IT FURTHER RESOLVED that the Front Yard Setback Variance for a Home Addition for 589 Emerson Avenue West as proposed in Planning Case #05 -61 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
