RESOLUTION 05 -128
A RESOLUTION APPROVING A SIDE YARD SETBACK VARIANCE
FOR A HOME ADDITION AT 919 DELAWARE AVENUE
WHEREAS, Daniel P. Nelson have applied for a Side Yard Setback Variance for a Home
Addition at 919 Delaware Avenue [Springers Subdivision E 120 ft of Lot 9 (PID #27- 71600 - 091 -00)] as
proposed in Planning Case #05 -62; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on November 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council approve the Side
Yard Setback Variance for a Home Addition as presented to the Planning Commission on the evening of
November 22, 2005 and as shown in Planning Case #05 -62;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Side Yard Setback Variance for a Home Addition for 919 Delaware Avenue
as proposed in Planning Case #05 -62 is hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes
the following Findings of Fact:
1. The Mendota Heights Zoning Ordinance states that a side yard shall not be less than ten feet in
width.
2. The lot in question is only fifty feet wide.
3. The existing structure is of a similar size and position on the lot as the rest of the houses in the
neighborhood.
4. The structure is already positioned on the parcel in a nonconforming fashion.
5. The proposed additions will not further increase this nonconformity.
6. The proposed additions are of a reasonable size that do not greatly expand the building
footprint.
BE IT FURTHER RESOLVED that the Side Yard Setback Variance for a Home Addition for
919 Delaware Avenue as proposed in Planning Case #05 -62 under the above conditions would not have an
adverse impact on the health, safety, and general welfare of the citizens of the community and the
surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
