RESOLUTION 05 -129
A RESOLUTION APPROVING
A 14 -FOOT FRONT YARD SETBACK VARIANCE (DUE TO THE "STRING RULE ")
AND SIX -FOOT SIDE YARD SETBACK VARIANCE
FOR A HOME ADDITION AT 1319 DELAWARE AVENUE
WHEREAS, Darrell Guessford and Yeen C. Chong have applied for a 14 -Foot Front
Yard Setback Variance (due to the "String Rule ") and Six -Foot Side Yard Setback Variance for a
Home Addition at 1319 Delaware Avenue [Somerset Heights, Lot 2, Block 2, Except the West
100 Feet (PID #27- 71000 - 021 -02)] as proposed in Planning Case #05 -63; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on November 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the 14 -Foot Front Yard Setback Variance (due to the "String Rule ") and Six -Foot Side Yard
Setback Variance for a Home Addition as presented to the Planning Commission on the evening
of November 22, 2005 and as shown in Planning Case #05 -63;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a 14 -Foot Front Yard Setback Variance (due to the "String Rule ")
and Six -Foot Side Yard Setback Variance for a Home Addition for 1319 Delaware Avenue as
proposed in Planning Case #05 -63 is hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the Council
hereby makes the following Findings of Fact:
The Mendota Heights Zoning Ordinance states that whenever buildings have been
constructed on one side of the street between two intersections, no building shall be
erected to extend so as to project beyond a line drawn between the forward most
portion of the nearest building on either side.
2. The Mendota Heights Zoning Ordinance states that the side yard setback for single
family homes in the R -1 District shall be 10 feet.
3. The applicant has shown a hardship in complying with the zoning regulations in that
no reasonable alternative is available to accommodate the expansion of the home.
4. The addition, although requiring a 14 -Foot Front Yard Setback Variance (due to the
"String Rule ") due to the "string rule" described in #1 above, will not encroach into
the standard 30 -foot front yard setback required for all R -1 lots.
BE IT FURTHER RESOLVED that the 14 -Foot Front Yard Setback Variance (due to
the "String Rule ") and Six -Foot Side Yard Setback Variance for a Home Addition for 1319
Delaware Avenue as proposed in Planning Case #05 -63 under the above conditions would not
