RESOLUTION 05 -130
A RESOLUTION APPROVING
A TWENTY -FOOT FRONT YARD SETBACK VARIANCE
FOR A TEN SQUARE FOOT, SIX FOOT HIGH FREESTANDING SIGN
AT 2150 DODD ROAD
WHEREAS, Mike and Kathy Doyle have applied for a Twenty -Foot Front Yard Setback
Variance for a Ten Square Foot, Six Foot High Freestanding Sign at 2150 Dodd Road [Section
23 N 155.7 ft of S 713.4 ft of W 208.7 ft of SW Quarter of SW Quarter (PID #27- 02500- 040 -52)]
as proposed in Planning Case #05 -64; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on November 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the Twenty -Foot Front Yard Setback Variance for a Ten Square Foot, Six Foot High
Freestanding Sign as presented to the Planning Commission on the evening of November 22,
2005 and as shown in Planning Case 405 -64;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Twenty -Foot Front Yard Setback Variance for a Ten Square
Foot, Six Foot High Freestanding Sign for 2150 Dodd Road as proposed in Planning Case #05 -64
is hereby approved on the following conditions:
1. The hours of illumination for the sign shall be limited to 6:00 am to 10:00 pm Monday
through Friday.
2. The lighting shall meet the City's standards and shall not create glare for neighboring
properties or passing motorists.
BE IT FURTHER RESOLVED that in support of the above approval, the Council
hereby makes the following Findings of Fact:
Sign visibility is obscured by existing buildings and vegetation.
2. Obscured business identification can lead to roadway safety issues in this location.
The request is similar in nature to that of the recently approved Animal Clinic sign
variance.
4. The sign meets all other sign ordinance requirements.
BE IT FURTHER RESOLVED that the Twenty -Foot Front Yard Setback Variance for
a Ten Square Foot, Six Foot High Freestanding Sign for 2150 Dodd Road as proposed in
Planning Case #05 -64 under the above conditions would not have an adverse impact on the
health, safety, and general welfare of the citizens of the community and the surrounding land,
and would not be adverse to the general purpose and intent of the Zoning Ordinance.
