A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR AN ACCESSORY STRUCTURE AT 1455 MENDOTA HEIGHTS ROAD
WHEREAS, Matthew P. Ropchak have applied for a Conditional Use Permit for a 1,200
Square Foot, 32 -Foot High Accessory Structure at 1455 Mendota Heights Road [Sec. 33 Twn 28
Range 23, Pt. of govt lot 2 com SE cor sec 33 -28 -23 N 1320 ft W 660 ft to beg N 357.48 ft N
68D07M30S W 443.42 ft to E R/W STH #13 S 21D52M30S W on R/W 375.63 ft MIL to C/L
Mendota Hts Rd SE on C/L 587.09 ft to beg (PID #27- 03300 - 060 -78)] as proposed in Planning
Case #05 -65; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on November 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the Conditional Use Permit for a 1,200 Square Foot, 32 -Foot High Accessory Structure as
presented to the Planning Commission on the evening of November 22, 2005 and as shown in
Planning Case #05 -65;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a 1,200 Square Foot, 32 -Foot High
Accessory Stricture for 1455 Mendota Heights Road as proposed in Planning Case #05 -65 is
hereby approved under the following conditions:
The accessory structure must be of the same color and design as the existing
principal structure.
The applicant shall be required to receive all relevant local and State permits for the
storage and pretreatment of waste. Copies of these permits shall be provided to the
City.
The applicant shall provide the City with parking count information. The applicant
shall be required to maintain the minimum parking stall count required for the site
under the Ordinance.
4. The applicant shall demonstrate how the loading and circulation plan will occur
during and after construction.
BE IT FURTHER RESOLVED that in support of the above approval, the Council
hereby makes the following Findings of Fact:
The proposed project will improve wastewater treatment for both public and private
purposes.
2. The proposed building will not increase parking or traffic on the site.
4. The proposed accessory building meets all zoning ordinance standards for setback,
height, and other regulations.
BE IT FURTHER RESOLVED that the Conditional Use Permit for an Accessory
Structure for 1455 Mendota Heights Road as proposed in Planning Case #05 -65 under the above
conditions would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the general
purpose and intent of the Zoning Ordinance.
