Res 2007- 30 Approving CUP @ 686 2nd AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -30 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AT 686 2ND AVE WHEREAS, Vernon Edgerton has applied for a Conditional Use Permit at 686 2nd Ave [PIN: 27- 63131 - 010 -01] as proposed in Planning Case #07 -08; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on April 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit as presented to the Planning Commission on the evening of April 25, 2007 and as shown in Planning Case #07 -08. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit as proposed in Planning Case #07 -08 is hereby approved: BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed five -foot fence is consistent with the Conditional Use Permit criteria for such fences. 2. The construction of the proposed fence will correct an existing non - conformity by relocating the fence -line of the right of way. 3. The fence will meet the City's requirements for screening in combination with the existing landscaping. 4. Approval of the Conditional Use Permit for the proposed fence is not anticipated to have a negative effect on the public's health, safety or welfare.
