Res 2007- 33 Approving Critical Area & CUP @ 1312 Wachtler AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07-33 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND CRITICAL AREA PERMIT FOR A DETACHED GARAGE AT 1312 WACHTLER AVE WHEREAS, Carol Nelson has applied for a Conditional Use Permit and a Critical Area Permit at 1312 Wachtler Ave [PIN: 27-03800-030-27] as proposed in Planning Case #07-12; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on April 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit and Critical Area Permit as presented to the Planning Commission on the evening of April 25, 2007 and as shown in Planning Case #07-12. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and Critical Area permit as proposed in Planning Case #07-12 is hereby approved: BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed detached garage is consistent with the Conditional Use Permit criteria for such structures. 2. Approval of the Conditional Use Permit for the proposed detached garage is not anticipated to have a negative effect on the public's health, safety or welfare. 3. Approval of the Critical Area Pen-nit for the proposed detached garage meets the policies and standards of the Critical Area Ordinance.
