Res 2007- 37 Denying Land Use Plan AmendmentCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07-37 A RESOLUTION DENYING A COMPREHENSIVE LAND USE PLAN AMENDMENT FROM "I" TO "B" DISTRICT WHEREAS, Dale Glowa has applied for a Comprehensive Plan Amendment from I to B at 1494 and Pilot Knob Road [PIN: 27-48300-010-06] as proposed in Planning Case #07-14; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on April 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Comprehensive Plan Amendment as presented to the Planning Commission on the evening of April 25, 2007 and as shown in Planning Case #07-14. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Comprehensive Plan Amendment from I to B in Planning Case #07-14 is hereby denied. BE IT FURTHER RESOLVED that in support of the above denial, the Council hereby makes the following Findings of Fact: 1. Commercial use is inconsistent with the City's current vision for the area as articulated in the Comprehensive Plan. 2. A convenience store with 24 hour operations would increase the number of police calls to the area. 3. The retail uses will create lighting and visual impacts that are inconsistent with the nature of the area. Adopted by the City Council of the City of Mendota Heights This 15th day of May, 2007.
