RESOLUTION 07 -60
A RESOLUTION APPROVING CONDITIONAL USE PERMITS AND VARIANCE FOR A
SCREENED BUILDING AT 555 HUBER DRIVE
WHEREAS, Dave Napier has applied for a conditional use permit for an accessory structure of
280 square feet, a conditional use permit for 691 square feet of total accessory building space and
Variance to construct an accessory building closer than the principle structure to the front of the lot at 555
Huber Drive [PIN: 27- 30200- 250 -00; Glen Toro Pt Lots 20 and 25 Lying W and S of line beginning
982.5 feet W and 40 feet N of SE Cor Sec N 5D 25M W to W Line Lot 20 and there Term 01000] as
proposed in Planning Case #07 -19; and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on June 26, 2007; and
WHEREAS, The Planning Commission voted to recommend that the Council approve the
Conditional Use Permits and Variance as presented to the Planning Commission on the evening of June
26, 2007 and as shown in Planning Case #07 -19.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a conditional use permit for an accessory structure of 280 square feet, a
conditional use permit for 691 square feet of total accessory building space and Variance to construct an
accessory building closer than the principle structure to the front of the lot at 555 Huber Drive as
proposed in Planning Case #07 -19 is hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby
makes the following Findings of Fact:
1. The proposed accessory building will not alter the essential character of the neighborhood.
2. The parcel is very large and the proposed structure is setback from the road right of way and the
nearest adjacent structure is setback from the road right of way and nearest adjacent structures a
long distance.
3. The application is consistent with the Comprehensive Plan subject to the following conditions:
a. The structure shall not exceed fifteen feet in height.
b. The accessory building shall not be used as an occupied dwelling primarily for human
habitation at any time.
c. The applicant shall provide adequate parking for the group gatherings, lunches and
dinners that are hosted on site.
