Res 2007- 61 Approving Variance @ 684 3rd AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -61 A RESOLUTION APPROVING A T VARIANCE TO THE SIDE YARD SETBACK FOR A SCREENED PORCH AT 684 3rd AVE WHEREAS, Lou Closmore has applied for a 7' variance to the side yard sethacl< for an addition at 684 ) Ave [PIN: 27- 69703 - 060 -05, Lot 6, Block 5 E.T. Smith Sub Div 94] as proposed in Planning Case #07 -20; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on .Lune 26, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the variance as presented to the Planning Commission on the evening of June 26, 2007 and as shown in Planning Case #07 -20. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the Citv of Mendota Heights that a 7' Variance to the Side Yard Setback for an addition at 684 3rd Ave as proposed in Planning Case #07 -20 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: I. The applicant has exhausted all other possibilities ?. The proposed porch is not being proposed any closer to the east property line than \ hat the liouse and detached garage are already located at 3, The addition would not alter the essential character of the neighborhood 4. A hardship is created due to the unique circumstances of the parcel: the lot is very narrow, fronted by two public streets 5. The application is consistent with the Comprehensive Plan.
