A RESOLUTION APPROVING AS`VA0ANCE TO THE SIDE YARD SETBACK FOR
AN ADDITION A][771 PONDHAVEN LANE
WHEREAS, Brian Farley has applied for a 3' variance to the side yard setback for a
addition at 771 Pondhaven Lane [PIN: 27-15150-010-02, Lot 1, Block 2 Bridgeview Shores I"
udbion] as proposed io Planning Case #07-22; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting ou June 26`2007;and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the variance ns presented tothe Planning Commission oo the evening nf June 2h,2007 and uo
shown iu Planning Case #O7-22.
NOW, THEREFORE, 0[D0 HEREBY RESOLVED by the City Council ofthe
City of Mendota Heights that a 3' variance to the side yard setback for an addition at 771
Poudbuveo Lane an proposed bz Planning Case #O7-2%io hereby approved.

hereby makes the following Findings of Fact:
l. The applicant has exhausted all other possibilities
2. The addition would not alter the essential character of the neighborhood
3. A hardship is created due to the unique circumstances of the parcel not created by the
applicant
4. The is consistent with the Comprehensive Plao
