Res 2007- 69 Agreement for Use of Dakota County 800 MHz SystemCOUNTY SUBSCRIBER SUBSYSTEM FOR 800 MHZ RADIOS City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 07- 69 A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF SUBSCRIBER AGREEMENT WITH DAKOTA COUNTY FOR USE OF THE DAKOTA COUNTY 800 MHZ RADIO SUBSYSTEM WHEREAS, by Resolution No. 07-44 on 06-05-2007, the Mendota Heights City Council authorized the City to join the Metropolitan Regional 800 MHz System; and WHEREAS, by Resolution No. 05-64 on 08-16-2005, the Mendota Heights City Council approved the Dakota Communications Center Joint Powers Agreement for public safety dispatch services; and WHEREAS, Dakota County has entered into a cooperative agreement with MES13 and MNDOT for the purpose of defining the rights and obligations of each party with respect to the design, procurement, construction, ownership, operations, funding, and maintenance of a County/Regional Integrated Subsystem and the submission of the Dakota County 800 MHz Radio Plan to the Metropolitan Radio Board; and WHEREAS, The City of Mendota Heights has promoted partnerships between units of government to facilitate the construction of the Dakota County 800 MHz Radio Subsystem; and WHEREAS, a Subscriber Agreement is needed to define the terms and conditions between the City and the County for the use of the Dakota County subsystem; and WHEREAS, as part of the Subscriber Agreement the County has established an 800 MHz Policy Work Group for the purpose of making recommendations to the County Board regarding operating and financial policies for the County 800 MHz trunked radio subsystem Whereas, the City will have representation on the Policy Working Group. NOW, THEREFORE, BE IT RESOLVED, That the City of Mendota Heights hereby approves the Subscriber Agreement between the City and Dakota County and authorizes the City Manager/Administrator to execute the Subscriber Agreement for City use of the Dakota County 800 MHz Radio Subsystem; and 1. k Resolutions12 M07-69 8-01-07 DC Radio Subscriber Agrmnt Res. docPage 1 COUNTY SUBSCRIBER SUBSYSTEM FOR 800 MHZ RADIOS BE IT FURTHER RESOLVED, That the initial terms of the agreement shall be from the effective on the date it is executed by both parties and will continue through December 31, 2012 ("Initial Term") and will automatically be extended for additional one (1) year terms unless terminated.
