Res 2007-111 Approving A CUP @ 1480 Sibley Memorial Hwy (2)CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -111 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AT 1480 SIBLEY MEMORIAL HIGHWAY WHEREAS, Susan Stotts has applied for a Conditional Use Permit at 1480 Sibley Memorial Highway for the construction of an accessory structure [PIN: 27- 03300 - 020 -75, 27- 03300- 031 -78; legal description attached] as proposed in Planning Case #07 -40; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 23, 2007; and WHEREAS, The Planning Commmission voted to recommend that the Council approve the Conditional Use Permit as presented to the Planning Commission on the evening of October 23, 2007 and as shown in Planning Case #07 -40. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit at 1480 Sibley Memorial Highway as proposed in Planning Case #07 -40 is hereby approved with the following conditions: a) All of the requirements of Section 12 -1 -G -4 have to be met prior to the issuance of any building pen-nit. b) The accessory structure shall be located at least five (5) feet from the principal building. c) The proposed accessory structure shall be constructed of materials comparable in quality and appearance to those used in the original /principle building and shall be designed in a manner confonning with the original architectural design and general appearance. d) The walls and materials of the accessory structure shall be of a similar type, quality and appearance as the principal structure and compatible with other structures in the area. e) A landscape plan shall be submitted prior to building permit approval and shall follow the requirements of Section 12- 1D- 13 -2.D BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. that the proposed structure will not affect the health, safety, and general welfare of the residents, surrounding lands or overall community 2. It will not depreciate the surrounding property value 3. It will not negatively affect the Comprehensive Plan 4. It is in hannony with the general purpose and intent of the Zoning Ordinance. BE IT FURTHER RESOLVED that staff is hereby authorized to issue a building permit for an accessory structure as defined in planning case 07 -40.
