Res 2007-102 Approving Critical Area Permit @ 1813 Lexington AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -102 A RESOLUTION APPROVING A CRITICAL AREA PERMIT AT 1813 LEXINGTON AVE SOUTH WHEREAS, Ed Chavez has applied for a Critical Area Permit at 1813 Lexington Ave So for the replacement of a deck [PIN: 27- 02700 - 010 -01; Section 27 Town 28 Range 23, parcel 26074 -B E 231 ft of N 214.50 ft of NE qr. Ex S 30 ft for road] as proposed in Planning Case #07- 38; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit as presented to the Planning Commission on the evening of September 25, 2007 and as shown in Planning Case #07 -38. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Critical Area Permit at 1813 Lexington Ave S as proposed in Planning Case #07 -38 is hereby approved with the following condition: 1. A building permit shall be obtained prior to construction of the proposed screen porch. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed improvements do not conflict with the Critical Area Ordinance regulations or objectives. Adopted by the City Council of the City of Mendota Heights This 2nd day of October, 2007.
