Res 2007-101 Approving Wetlands Permit @ 2496 Bridgeview CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -101 A RESOLUTION APPROVING A WETLANDS PERMIT AT 2496 BRIDGEVIEW COURT WHEREAS, Jorge Maldonado has applied for a Wetlands Permit at 2496 Bridgeview Court to clear brush and construct a walking path [PIN: 27- 15150- 090 -04; Lot 9 Block 4 Bridgeview Shores] as proposed in Planning Case #07 -37; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit as presented to the Planning Commission on the evening of September 25, 2007 and as shown in Planning Case #07 -37. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit at 2496 Bridgeview Court as proposed in Planning Case #07 -37 is hereby approved with the following conditions: 1. The placement of the walking path shall not adversely affect the drainage and utility easement. 2. All activities related to grading and drainage of the site shall be subject to the review of the City Engineer. 3. The removal of vegetation shall remain outside the actual wetland and be limited to that which is reasonably required for the placement of the walking path. 4. The applicant shall consider the use of permeable materials if practical. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The application is consistent with the intent of the Wetlands Ordinance in that the proposed walking path and sitting area does not appear that it will interfere with the water quality of the wetland; it will not adversely impact the surrounding environment; and it will not increase the stormwater runoff to the wetland.
