Res 2007-100 Approving Critical Area & CUP @ 1049 Douglas RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 07 -100 A RESOLUTION APPROVING A CRITICAL AREA PERMIT AND CONDITIONAL USE PERMIT AT 1049 DOUGLAS ROAD WHEREAS, David Olson has applied for a Critical Area Permit and Conditional Use Permit at 1049 Douglas Road for the construction of an accessory structure with an area of 192 sq ft. [PIN: 27- 76402- 090 -03; Lot 8 Block 3 and W 45 ft of Lot 9 Block 3, Tilsens Highland Heights #3] as proposed in Planning Case #07 -36; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 25, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit and Conditional Use Permit as presented to the Planning Commission on the evening of September 25, 2007 and as shown in Planning Case #07 -36. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Critical Area Permit and Conditional Use Permit at 1049 Douglas Road as proposed in Planning Case #07 -36 is hereby approved with the following condition: 1. A building permit shall be obtained prior to construction of the proposed accessory j structure. 2. The detached accessory building shall not be located nearer the front lot line (road right of way) than the principal building on the lot and shall meet the required 30 foot setback from the front property line. 3. The proposed accessory structure shall not exceed fifteen feet (15') in height. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed structure will not affect the health, safety, and general welfare of the residents, surrounding lands, or overall community; it will not depreciate the surrounding property value; it will not negatively affect the Comprehensive Plan; it is in harmony with the general purpose and intent of the Zoning Ordinance; and it will not jeopardize the aesthetic integrity and natural environment of the Mississippi River Corridor Critical Area.
