1987-03-17 Council minutesPage No. 2406 March 17, 1987 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, March 17, 1987 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Blesener, Cummins, Hartmann and Witt. AGENDA ADOPTION Councilmember Hartmann moved adoption of the agenda for the meeting, including items contained in the add -on agenda. Ayes: 5 Councilmember Witt seconded the motion. Nays: 0 APPROVAL OF MINUTES Councilmember Cummins moved approval of the minutes of the March 3rd meeting. Councilmember Hartmann seconded the motion. Ayes: 5 Nays: 0 CONSENT CALENDAR Councilmember Hartmann moved approval of the consent calendar as submitted and recommended for approval as part of the regular agenda, along with authorization for execution of all necessary documents contained therein. a. Acknowledgment of the minutes of the February 11th Park Commission meeting. b. Acknowledgment of the monthly Treasurer's report for February. c. Acknowledgment of the Fire Department monthly report for February. d. Adoption of Resolution No. 87 -25, "RESOLUTION APPOINTING SPECIAL ELECTION JUDGES." e. Approval of a request from the City Engineer to reduce the frequency of the Engineer's Report to a quarterly basis during the off - season but on a monthly basis during the construction season. f. Approval of the List of Claims dated March 17, 1987 and totalling $613,710.80. Approval of the list of contractor licenses dated March 17, 1987 and attached hereto. Councilmember Cummins seconded the motion. Dr. Tom Koepke was present to request approval of the installation of a six foot high fence to replace an existing three foot fence at the Mendota Heights Animal Hospital site. Mayor Mertensotto stated that he believes the standard kennel fence height is five feet and felt that the proposed fence should be reduced to five feet. After discussion, Councilmember Cummins moved to approve the issuance of a permit for a six foot high fence for an animal exercise area at 1938 Dodd Road. Councilmember Hartmann seconded the motion. On the recommendation of the Public Works Director, Councilmember Cummins moved that the contract for 1987 street sweeping be awarded to Knutson Clean Sweep for their low bid of $46.00 per hour. Councilmember Blesener seconded the motion. Councilmember Hartmann moved adoption of Resolution No. 87 -26, "RESOLUTION ORDERING THE PREPARATION OF ASSESSMENT ROLL FOR I.O.S. PLAZA ADDITION AND ADJACENT AREAS (IMPROVEMENT NO. 82, PROJECT NO. 8) . Councilmember Cummins seconded the motion. Councilmember Hartmann moved adoption of Resolution No. 87 -27, "RESOLUTION CALLING FOR HEARING ON ASSESSMENT ROLL FOR I.O.S. PLAZA ADDITION AND ADJACENT AREA IMPROVEMENTS (IMPROVEMENT NO. 87, PROJECT NO. 7)," the hearing to be held on April 21st. Councilmember Cummins seconded the motion. Councilmember Witt moved adoption of Ordinance No. 230, "AN ORDINANCE AMENDING ORDINANCE NO. 1113," to add Medora Road, north and south bound, at Page No. 2408 March 17, 1987 Emerson Avenue as stop streets and Knollwood Lane, north and south bound, at Emerson as stop streets, and to delete the yield street designation for Medora Road north and south bound at Emerson Avenue. Councilmember Blesener seconded the motion. Councilmember Cummins moved adoption of Resolution No. 87-28, "RESOLUTION APPROVING FINAL PLAT," for the Spring Creek Acres addition along with authorization for execution of the developer's agreement by the Mayor and City Administrator. Councilmember Witt seconded the motion. The Council acknowledged and discussed a memo from the Public Works Director recommending the appointment of a temporary Code Enforcement Intern. Mayor Mertensotto expressed concern over potential City liability for workers compensation since the candidate, Richard Gill, has had a recent back injury. He felt that the City should require some type of liability waiver. Administrator Frazell explained that the candidate is registered with the second injury fund under workers compensation and there should be no liability question. After discussion, Councilmember Witt moved to appoint Richard Gill as 1987 Code Enforcement intern effective March 18th at the rate of $8.50 per hour, and to increase the Code Enforcement budget for the position by $6,000. Councilmember Hartmann seconded the motion. On the recommendation of the Public Works Director, Councilmember Blesener moved that Gregg Gund be hired as a temporary, full-time engineering technician at the rate of $8.50 and that staff be directed to prepare an employment agreement specifying the terms of employment, including the length of employment being 8 months, benefits as recommended in the Public Works Director's memo, and a waiver of rights to unemployment compensation. Councilmember Witt seconded the motion. Councilmember Witt moved to authorize payment of $10,000 for the necessary utility and trailway easements as recommended, or if the offer is unacceptable, to direct the City Attorney to proceed with condemnation of the easement, the cost of easement acquisition to be offset by the delinquent park contribution and outstanding interest. Councilmember Hartmann seconded the motion. Councilmember Hartmann moved to authorize the City Attorney to commence action to recover the delinquent Eide Addition park contribution and outstanding interest if there is no favorable reaction to easement negotiations. Councilmember Cummins seconded the motion. To avoid conflict over use of the Council Chambers for the processing of the Special Park Election, Councilmember Hartmann moved that the April 21st regular meeting be rescheduled to April 22nd at 7:30 P.M. Councilmember Witt seconded the motion. The Council directed the City Administrator to draft a Council letter of support for the Park Referendum. Councilmember Cummins directed the Administrator to be sure that there is community identity in the athletic complex name. Councilmember Witt suggested that there be a question and answer page, or flyer insert, in the newsletter or in the local papers. Administrator Frazell was directed to explore available options for distribution of a question and answer sheet. The Council acknowledged a report from the Public Works Director regarding a Mn/DOT/County agreement over relocation of the Victoria/13 intersection. Councilmember Cummins moved to authorize creation of an administrative secretary position, effective April 15th, to be placed at Step D of Grade V of the pay matrix and that Kimberlee Blaeser be promoted to the position, and that staff be authorized to advertise for and select a Receptionist/Clerk Typist to commence work on April 20th at Step A, Grade I of the pay matrix. Councilmember Blesener seconded the motion. The Council discussed a proposal from Dahlgren, Shardlow & Uban for preparation of a comprehensive study of the Highway 55 corridor area. Councilmember Blesener moved to approve execution of the proposed contract conditioned upon submission of a time schedule for completion of the work and on the basis that the consultants submit monthly progress reports to Council. Councilmember Hartmann seconded the motion. The Council discussed a memo from the City Administrator relative to the proposed 1987 police bargaining unit contract. There was some discussion over comparable worth implications. Councilmember Cummins stated that he objects to pattern bargaining and suggested that perhaps the City should go to arbitration since the comparable worth study has shown that many of the positions are overcompensated. After discussion, Councilmember Blesener moved to approve the 1987 Police Bargaining Unit Contract as recommended by the City Administrator. Councilmember Hartmann seconded the motion. Public Works Director Danielson reviewed his memo recommending that the City Attorney be authorizedto enter eminent domain proceedings to acquire utility and trail easements over two lots in the Eide Addition. It was noted by Attorney Hart that the property owner is significantly delinquent in the payment of the park contribution due as part of the platting of Eide Estates.
