Page No. 2443 January 3, 1989 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, January 3, 1989 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Blesener, Cummins, Hartmann and Witt. OATH OF OFFICE AGENDA ADOPTION Ayes: 5 Nays: 0 APPROVAL OF MINUTES Ayes: 5 Nays: 0 'CONSENT CALENDAR The City Clerk administered the Oath of Office to Mayor Mertensotto, Councilmember Blesener and Councilmember Cummins, who had been re-elected to office on November 8th. Councilmember Hartmann moved adoption of the revised agenda for the meeting. Councilmember Witt seconded the motion. Councilmember Witt moved approval of the minutes of the December 6th meeting. Councilmember Hartmann seconded the motion. Councilmember Witt stated that she takes exception to the inclusion of the payment to Rainbow Equipment for the purchase of playground equipment for the Curley Addition tot lot. Councilmember Hartmann moved approval of the consent calendar for the meeting, along with authorization for execution of all necessary documents contained therein. a. Acknowledgment of a letter from the St. Paul Water Utility regarding 1989 water rates. b. Approval of the payment of the City's 1989 contribution of $5,078.00 to the Lower Mississippi River WMO. Page No. 2444 January 3, 1989 c. Approval of the List of Pledged Securities prepared by Treasurer Shaughnessy and dated January 2, 1989. d. Adoption of Resolution No. 89 -01, "RESOLUTION ESTABLISHING 1989 CITY DEPOSITORIES OF FUNDS." e. Approval of the execution of a Joint Powers Agreement with Dakota County for receipt of a recycling grant. f. Acknowledgment of the Code Enforcement monthly report for December. g. Adoption of Resolution No. 89 -02, "RESOLUTION APPROVING FINAL PLAT FOR VICTORIA HIGHLANDS 4TH ADDITION." h. Acknowledgment of an informational memo on the Curley Tot Lot. i. Approval of the list of contractor licenses dated January 3, 1989 and attached hereto. Approval of the list of cigarette licenses. k. Approval of the list of Rubbish Hauler licenses to be effective through March, 1989. 1. Approval of the issuance of a permit to the Dakota County State Bank for replacement of the Mendota Heights City Office message from the bank sign at the northeast corner of t.H. 149 and South Plaza Drive with information about an instant cash machine. m. Approval of the List of Claims dated January 3, 1989 and totalling $192,307.16. Councilmember Witt seconded the motion. Ayes: 5 Nays: 0 ACTING MAYOR Councilmember Cummins moved that Councilmember Witt be appointed to serve as Ayes: 5 Nays: 0 HEALTH OFFICER Ayes: 5 Nays: 0 OFFICIAL NEWSPAPER Ayes: 5 Nays: 0 NORTH IVY HILLS PUBLIC IMPROVEMENTS Page No. 2445 January 3, 1989 Acting Mayor for 1989. Councilmember Hartmann seconded the motion. Councilmember Hartmann moved that Dr. Thaddeus Chao be appointed as the City's Health Officer for 1989. Councilmember Blesener seconded the motion. Council acknowledged and discussed letters from the Minnesota Suburban Newspapers (Sun Current) and Lillie Suburban Newspapers (South-West Review), requesting designation as the City's official newspaper for 1989. Councilmember Cummins felt that Council should consider designating the Review, commenting that delivery of the Review has become regular while delivery of the Sun has decreased. Mayor Mertensotto stated that he would agree with Councilmember Cummins if surrounding communities were publishing their legals in the Review, but that he would be hesitant to be the only community in the County to publish in the Review. He further stated that residents are accustomed to looking for legal notices in the Sun. After further discussion, Councilmember Witt moved to designate the Sun Current as the City's official newspaper for 1989. Councilmember Hartmann seconded the motion. Council acknowledged a petition from the Federal Land Company for public improvements to serve the North Ivy Hills 2nd Addition. Responding to a question from Mayor Mertensotto, Public Works Director Danielson stated that the developers have submitted an engineering escrow of $150 per lot as is required by Ordinance prior to preparation of a feasibility study. Councilmember Cummins moved adoption of Resolution No. 89 -03, "RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF FEASIBILITY REPORT FOR NORTH IVY HILLS 2ND ADDITION." Councilmember Hartmann seconded the motion. Council acknowledged and discussed a memo from Public Works Director Danielson regarding consulting assistance for the Citizens' Park Committee. Councilmember Blesener stated that she had asked staff to request a proposal from Barton - Aschman for assistance to the Citizens Park Committee, but that it seemsto be more appropriate to establish a maximum figure of $2,500 for consulting services and use the consultants as necessary within that limit. She felt that much of what the committee needs is already done and that staff can do much of what is still needed. Councilmember Witt moved to authorize staff to enter into a contract with Barton - Aschman to provide consulting services at the hourly rate schedule contained in the Barton - Aschman proposal, the total amount for services not to exceed $2,500. Councilmember Blesener seconded the motion. Council acknowledged the Citizens Park Committee objectives statement. Mayor Mertensotto suggested that the Administrator should contact St. Thomas College to prepare a 5 -year CIP and citizen survey. Administrator Frazell recommended that the suggestion be discussed at the 1989 team building session. Council acknowledged and discussed a set of legislative policies compiled and proposed by the County Administrator and city managers and administrators throughout Dakota County. COMMISSION APPOINTMENTS Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 MENDOTA HEIGHTS BUSINESS PARK • Page No. 2447 January 3, 1989 Councilmember Witt discussed the tax reform issue and stated that she would prefer that the County not take a stance on the issue at this time. Administrator Frazell responded that the proposed stance is really a support for retention of the homestead credit as it existed in 1987. With regard to the airport issue, it was Council consensus that it would not want to take a position which would rule out the possibility of a Rosemount area airport site, and that Item a of the regional airport policy recommendation should be deleted. Administrator Frazell informed Council that the city administrators and managers and County Administrator Wray will meet on Thursday, January 5th to discuss the proposed policies. Councilmember Witt moved to accept the resignation of Mike Sokol as the City's citizen representative to the NDC-4, effective on January 1, 1989. Councilmember Hartmann seconded the motion. Councilmember Hartmann moved that Ron Rogosheski, 2333 Rogers Avenue, be appointed to replace Mike Sokol as the citizen representative on the NDC-4, the appointment to be effective immediately. Councilmember Witt seconded the motion. Council was informed that Planning Commission members Sandra Krebsbach and Ultan Duggan and Park Commission members John Huber, Bob Leffert and Bill Owens have expressed interest in reappointment. Council also acknowledged a list of citizens who have expressed interest in Commission appointment in the past. Mayor Mertensotto directed the City Clerk to contact Ms. Sharon Koll to see if she is still interested in Commission appointment. Council acknowledged a memo from Public Works Director Danielson regarding County denial of the United Properties Mendota CABLE BROADCASTING Page No. 2448 January 3, 1989 Heights Business Park plat because of driveway spacing. Mr. Danielson explained that the County also denied a request for variance from the County's driveway spacing guidelines but indicated that the proposed accesses on Pilot Knob would be allowed if the road is turned back to the City. Mayor Mertensotto stated that if the City asks for the turn-back, it should be stipulated that the road must be brought up to standards before the City will accept Pilot Knob as a City street. Mr. Danielson responded that typically the County overlays roads before turn-back but that he is not sure when the turn-back would occur. He felt that the City would want the action to be contingent on the upgrading of that portion of Pilot Knob north of future T.H. 13 which will not be reconstructed by Mn/DOT when Highway 13 is upgraded. Responding to a question from Mayor Mertensotto on a timetable for development of the plat, Mr. Dale Glowwa stated that a Big Wheel facility proposed to be constructed on 6 acres of land in the plat must begin construction on March 1st. It was the consensus that Council would have no problem with approving the access points as proposed by United Properties. Council directed Public Works Director Danielson to get information from the County Engineer as to how the turn-back will be handled and to indicate to the County Engineer that the City will agree to the turn-back but must receive a guarantee that the road will be upgraded before turn- back occurs. Public Works Director Danielson was also directed to contact Mn/DOT to be sure that it will allow the proposed driveway accesses. Action on the matter was tabled until the necessary information is received from the County Engineer and Mn/DOT. Council acknowledged a memo from the City Administrator, regarding policy issues surrounding the taping and broadcast of Council meetings. Administrator Frazell ( ADJOURN Ayes: 5 Nays: 0 ATTEST: Page No. 2449 January 3, 1989 informed Council that the audio portion of the cable system is not yet working and that Cable Administrator Vicky Long will be present to discuss cable policy at the January 17th meeting. Discussion on the cable broadcasting policy was tabled until January 17th. There being no further business to come before Council, Councilmember Hartmann moved that the meeting be adjourned.
