RESOLUTION 07 -:123 A RESOLUTION APPROVING A FIVE FOOT VARIANCE TO THE SIDE YARD SETBACK WHEREAS, Jim Moras on behalf of Joseph and Charleen Koppi has applied for a Five Foot Variance to the Side Yard Setback for the construction of an addition to the existing home at 975 Delaware Ave [PIN: 27- 58500- 090 -00; Posavad's Addition, Lot 9] as proposed in Planning Case #07 -43; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on November 27, 2007; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Variance as presented to the Planning Commission on the evening of November 27, 2007 and as shown in Planning Case #07 -43. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a five foot variance to the side yard setback at 975 Delaware Ave as proposed in Planning Case #07 -43 is hereby approved with the following Findings of Fact: 1. The applicant has considered several other design alternatives; 2. The proposed addition will not alter the essential character of the neighborhood; 3. The larger home pen-nits the structure to be closer to confonnance with reasonably sized single family homes; 4. The hardship is due to circumstances unique to the property and not created by the landowner — the subject parcel is very narrow and small in area, not allowing for many possibilities with regard to meeting setback requirements; 5.
