A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
WHEREAS, Debra Weiss has applied for a Conditional Use Permit for the addition of
an antenna on the water tower and to for ground equipment at 2431 Lexington Ave S [PIN: 27-
48200- 010 -01; Lot 1, Block 1, Medallion Park (NE 1/a SE' /a)] as proposed in Planning Case
#07 -44; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on November 27, 2007; and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the Conditional Use Permit as presented to the Planning Commission on the evening of
November 27, 2007 and as shown in Planning Case #07 -44.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a conditional use permit at 2431 Lexington Ave S as proposed in
Planning Case #07 -44 is hereby approved with the following conditions:
a. The new antennas shall be placed in similar fashion on the tower pedestal as the existing
antennas.
b. Unused or obsolete freestanding antenna towers, antennas, structures or apparatus must
be removed within six (6) months of when the operation ceases.
c. The applicant shall submit proof of any applicable federal, state, or local licenses to the
Council prior to receiving a building permit.
d. The applicant must agree to refrain from interfering with public warning systems and
public safety communications.
e. Three (3) blue spruce shall be added to the north side of the compound to add screening
from Lexington Ave.
BE IT FURTHER RESOLVED that in support of the above approval, the Council
hereby makes the following Finding of Fact: the proposed use will not negatively affect the
public health, safety and general welfare of the community.
