Poisonous or Harmful Vegetation in the Village of Mendota Heights*
The Village of Mendota Heights, in Common Council convened, ordains as follows
Section 1. Cutting and Removal. of Grass Needs and 'Other Rank oisonous Or ha-m.
Vegetation. It sha 1 be unlawful for any owner, lessee or °coupon , or any agent, serviiiil
represen5ative or employee of any suoh owner lessee or occupant having control of any
°coupled or unoccupied lot or land or nny part thereof in the Village of Mendota Heights
'to permit or maintain on any such loit or land, or on or along the sidewalk, street or
c 'alley adjacent to the same between the property line and the curb or middle of the alley
or for ten feet outside the property line if there -6St no curb, any growth of weedso'gras
or otherrank vegetation to the greater height than twelve (12) inches on the average, o/
any accumulation of dead weeds, grass or brush. It shall also be unlawful for any such
person or persons to Cause, suffer or allow poison ivy, ragweed or other poisonous plan:
or plants detrimental to health to grow on any such lot or land in such manner that an
part of such ivy, ragweed, or other poisonous or harmful weed shall extend upon, overha;
orborder any public place or allow to seed, pollen or other poisonous particles or ema . •
nations therefrom to bo carried through the air into any public place.
,30,#on 2. py of Owner Lessee or Occupant. It shall be thslodutyof any owner,
lessee or ocoupant of any lot or lan to out an remove or cause tOycut and removed all
such weeds, grass or other rank, poisonous or harmful vegetation as often as may be
necessary to comply with the provisions of Sectionl; provided that cutting and removing
such weeds, grass and vegetation at least once in every three weeks, between May 15 and
September 15 shall be deemed to be a compliahoe with this ordinance.
Section 3, When Village to do Work. If the provision of the foregoing sections
are not complied with the Weed Inspector shall serve written notice upon the owner, less
or occupant or any person having tho care or control of any such lot or land to comply
_with the provision of this ordinance. Ifthe person upon whom the notice is served fails`,
neglects or refuses to out and remove or to cause to be out and remove such weeds, grast
or other vegetation within five days after receipt of such notice, or if no person oan b
-found in the Village of Mendota Heights who either is or claims to be the owner of such
lot or land or who either represents or claims to represent such owner, the Weed Inspect
shall cause such weeds, grass and other vegetation on such lot or land to be out and rem
and the actual cost of such cutting and removal, plus five per cent for inspection and
other additional costs in connection therewith, shall bo certified by the Village Clerk
to the County Auditor and shall thereupon become and be a lien upon the property on
which such weeds, grass and other vegetation were located and shall be added to and becy
and form part of the taxes next to be assessed and levied upon such lot or land and shal
bear interest at the same rate as taxes and shall bo collected and enforced by the same
officer and in tho same manner as taxes.
Section 4. Penalty, Any person who shall neglect to out and remove weeds,, grass c
-)ther vegetation as direoted in this ordinanoe, or who shall fail, neglect or refuse to
amply with the prOvisions of any notice herein provided or who shall violate any of thE
,Jrovisions of this ordinance or who shall resist or obstruct tho Weed inspector or his
-,amployees in the cutting and removal of weeds, grass and other vegetation, shall,' upon
-cnviction thereof, be subject to a fine of not less than $25.00 or more than 4i100400
d each day on which such violation continues shall constitute a seperate offenee.
Section 5* Definition* The word "person" as used in this ordinance shall mean and
*ac-Alde one or more persons of either sex, natural persohs, corporations, partnerships,
oiations, joint stook cempanies„ societies and all other entities of any kind capab:
,2 being sued.
Section 6. All ordinances or parts of ordinances in conflict with the provislonE
of this ordinance are hereby repealed.
Section 7. This ordinance shp11take effect July 5,1956.
