AMENDMENT TO ZONING ORDINANCE
AN ORDINANCE AMENDING
AN ORDINANCE regulating and restricting the height.,
number of stories and_ size of buildings and other
structures; the percentage of lot that may be occu-
pied; the size of yard, courts, and other open spa-
ces; the density of population; the location and
use of buildings and land for trade, industry, re-
sidence.. or other purposes; creating districts for
said purposes and establishing the boundaries of
such districts; providing for changes in the regu-
lations, restrictions, and boundaries of such dis-
tricts; defining certain terms used herein;- provid-
ing for enforcement; and imposing fines and penal -
ties for violations.
The Village Council of Mendota Heights ordains as follows:
(1) Ordinance No. being an ordinance regulating and
restricting the height., number.of stories, and size of build-
ings and other structures, etc., commonly known as the zoning
ordinance, enacted May 1, 1956, and published May 10, 1956, as
heretofore amended., is hereby amended further in the following
respects:
(A) Article XII is amended to read as follows:
"ARTICLE XII
"Signs
"12.1 Notwithstanding the provisions of
Articles III to XI inclusive, the erection
and maintenance of signs shall be governed
by the provisions of this article.
1112.2 The several types of signs shall be per-
mitted only within the districts hereinbelow
specified.
"(I) Any class of district
"(a) Signs located upon or imme-
diately adjacent to premises law-
fully used for personal dwelling
purposes, setting forth any one or
more of the following: the name of
the occupant; the address of the
dwelling; the profession of the oc-
cupant, but only if the conduct of
such profession upon the premises
has been authorized by the Council;
the private nature of the premises
or driveway; warnings against tres-
passing; warnings against hunting;
and directional arrow; provided,
that the individual letters, figures
and symbols comprising any such sign
shall not exceed four inches in
height, with width and spacing in.
proportion to height.
"(b) Signs located upon or imme-
diately adjacent to premises law-
fully used for farm purposes or for
church, school, library, hospital
or other institutional or community
purposes., or for club., lodge or
other similar private purpose, iden-
tifying the said farm, institution,
club or lodge; provided that no such
sign shall exceed twelve square feet
in the area of one side.
"(c) Real estate signs located upon
or immediately adjacent to premises
being.offered for sale or rent, ad-
vertising such sale or rental; pro-
vided that no such sign shall exceed
twelve square feet in the area of
one side; and provided further that
each such sign shall be promptly re-
moved when the premises to which it
relates is no longer offered for sale
or rent. —
"(d) Real estate signs advertising
the location and direction of a re-
sidential real estate development;
provided that no such sign shall ex-
.ceed twenty-four square feet in the
area of one side; and provided fur-
ther that no more than two such signs
shall be permitted with respect to
any one real estate development,
"(e) Temporary signs for architects,
contractors, mechanics and artisans
located upon or immediately adjacent
to premises upon which construction,
alteration or repair is being law-
fully conducted pursuant to permit
issued by the Council;.provided that
the aggregate area, one side only,
of all such signs relating to any
one project., shall not exceed twen-
tyt-four square feet; and provided
further that each such sign shall
be removed promptly following com-
pletion of the work to which it re-
lates.
"(f) Business, commercial and in-
dustrial signs located upon premi-
ses upon which the business, commer-
cial or industrial activity adver-
tised thereon is being lawfully con-
ducted; provided that the aggregate
area, one side only, of all such
signs with respect to any one par"
eel of land shall not exceed fifty
square feet,
"(2) In business and commercial districts,
shopping center districts, light manufac-
turing districts and heavy manufacturing
districts only: signs of any nature.,'pro-
vided that no such sign shall exceed five
hundred square feet in the area of one
side; and provided further that no such
sign shall be located nearer than three
hundred feet to the traveled portion of
any road,, street or highway opened and
traveled by the public,
"12.3 All signs shall comply with the follow-
ing provisions:
"(1) No sign shall be so placed that it
may constitute a hazard to traffic on a
public traveled way by obscuring the view
or otherwise, 7

11(2) No illuminated sign shall be of a
flashing type,
"12.4 There shall be exempt from the provi-
siorsof this ordinance, the following-,
"(1) Signs duly authorized and erected
by public authority in the performance
of governmental functions;
"(2) Temporary signs of a political na-
ture; provided that each such sign shall
identify the name and address of the per-
son or organization sponsoring the sign,
and such person or organization shall re-
move every such sponsored sign not later
than sever days following the date of the

it relates; and provided further that the
owner or occupant of premises upon which
any such-sign has been posted without the
consent of such owner or occupant., may re-
move and destroy the same without liability
to anyone therefor.

1112.6 The phrase ?immediately adjacent to
premises! as used herein is defined to mean,
in the case of premises not located on a pub-
lic way, the point (or immediate vicinity
thereof) at which the private driveway or ease-
ment providing access to such premises enters
upon a public way; and, in the case of premises
located upon a lesser public way which is not
served by the United States mails., the nearest
point (or the immediate vicinity thereof) at
which mail service is available to such premi-
ses.
1112,7 The area of a non-rectangular sign is
determined to be area of the smallest rectan-
gle which can completely circumscribe such
sign."
(13) Section 15.1 is amended by adding thereto at
the end thereof the following:

"18 Sign. Every type of publicly displayed
visual presentation of words, letters, figures,
symbols or pictorial matter or any combination
thereof; including but not limited to bill-
] boards and other independent structures erected
for the purpose, structures affixed to build -
ings or other structures -, and printed or painted
- material affixed to existing structures.,"
(2) This ordinance shall take effect and be in force from and
after its passage and publications.
Enacted and ordained into an ordinance this day of
