Ord 21 Prohibit Discharging of FirearmsVILLAGE OF MENDOTA HEIGHTS Dakota County, Minnesota ORDINANCE NUMBER, AN ORDINANCE prohibiting the shooting or discharging of guns,_airguns, pistols, revolvers or other firearms within the Village of Mendota Heights and providing a penalty therefor. The Village Council of Mendota Heights ordains as follows: Section 1, No person shall hereafter shoot, fire off, discharge or explode any gun, airgun, pistol, revolver, or other firearm within the corporate limits of this Village, except as hereinaf- ter provided. Section 2. Nothing herein contained shall prohibit the use of firearms: a). by duly authorized policemen and law enforcement of- ficers, b)o when used in the lawful defense of person or property or family, c), when used in conjunction with a Youth Firearm Safety Training program duly approved by the appropriate of- ficials of the State of Minnesota and when operated under the supervision of Instructors certified by the Department of Conservation of the State of Minnesota, d). when used in conjunction with a target - shooting pro- gram supervised or approved by the National Rifle Association or a similarly recognized organization, e)8 by members and guests of duly incorporated gun clubs which shall have been in existence and incorporated under the laws of the State of Minnesota for the pre- vious five (5) years, provided, however, that any such use shall be restricted to land owned or leased by said club, f), by the owner or tenant of land solely for the protection of his own crops, livestock, or poultry, g). no use permitted in the foregoing subsections of this Section 2 shall be deemed to authorize the doing of any act or thing otherwise forbidden or regulated by any enactment of the United States or the State of Minnesota or regulations promulgated pursuant to any such enactment. Section 3. "Airgun0° means any air rifle, air gun, B -B gun, spring gun or similar device for the propulsion of shot or other metal or plastic pellet by means of compressed air, or mechanical spring action. Except as otherwise defined herein, all words and phrases shall have the same meaning and definition as contained in the ap- plicable Minnesota Statutes then in force and effect. Section 4. Any use of firearms permitted by subsections (e) and (f) of Section 2 hereof shall be limited to shotguns without slugs, and without the written permission of the owner, no use permitted by said subsections shall be made within 500 feet of any building occupied by a human being or by livestock, or within 500 feet of any stockade or corral containing livestock. Section 5. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed One Hundred Dollars ($100) or by imprisonment not to exceed ninety (90) days. Section 6. Effective date. This ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an ordinance this day ofL,U` 1958.
