AMENDMENT TO ZONING ORDINANCE
AN ORDINANCE AMENDING
AN ORDINANCE regulating and restricting the height,
number of storeys and size of buildings and other
structures; the percentage of lot that may be occu-
pied; the size of year, courts, and other open
spaces; the density of population; the location and
use of buildings and land for trade, industry,
residence, or other purposes; creating districts
for said purposes and establishing the boundaries
of such districts; providing for changes in the
regulations, restrictions., and boundaries of such
districts; defining certain terms used herein;
providing for enforcement; and imposing fines and
penalties for violations.
The Village Council of Mendota Heights ordains as follows:
,(I) Ordinance No. 5 being an ordinance regulating and
restricting the heights, number of storeys and size
of buildings and other structures, etc., commonly
known as the Zoning Ordinance, enacted May 1, 1956,
and published May 10, 1956, as amended, is hereby
amended in the following respects:
(a) Section 6.1 is amended to read as follows:
116.1 DESCRIPTION OF LANDS. Only the following
described land and those lands classified R -3,
Residence District (Multiple Dwelling) by sub-
sequent rezoning under Article XIV shall be
classified as R -3, Residence District (Multiple
Dwelling).
(1) "The South 200 feet of that part of the
West z of the East 2 of the Northwest 1 of
the Southwest ,- of Section 25, Township
28 N., Range 23 W. and the West z of the
Northwest 1 of the Southwest 1 of Section
25, Township 28 N., Range 23 W. lying South
of State Trunk Highway.#100 and East and
Southeast of State Trunk Highway #49, also
known as State Trunk Highway #88, as said
highways are presently laid out and West
of the new right -of -way line of State
Trunk Highway #49; " -
(b) Section 7.1 is amended to read as follows:
"7.1 DESCRIPTION OF LANDS. Only the following
described land and those lands classified BC,
Business & Commercial District by- subsequent
rezoning under Article XIV shall be classified
as BC, Business & Commercial District.
(1) "Beginning at a point on the Easterly side
of the right -of -way line of State Trunk
Highway #49, also known as State Trunk

Highway #88, as presently constituted, at
which point the Easterly boundary of the
West 2 of the Northwest 1 of the Southwest ,
Section 25, Township 28 N., Range 23 W. inter-
sects the said Trunk Highway #49 and thence
in a Southwesterly direction along the right -
of -way line along said Trunk Highway #49 a
distance of 150 feet; thence in a Southeasterly
direction at right angles a distance of 150
feet; thence in a Northeasterly direction at
right angles a distance of 150 feet and thence
in a Northwesterly direction at right angles
a distance of approximately 150 feet to the
point.of beginning.
(2) "Commencing at a point 1032 feet West and
345 feet North of the southeast corner of the
N.E. 1 of section 33, T. 28 N. R. 23 W. 4 th.,
thence North at right angles to the south line
of said N.E. 4 324 feet to =:the Southwesterly
line of the Chicago, Milwaukee, St. Paul and
Pacific R.R. right -of -way, thence Northwesterly
along the right of way line 500 feet to the
center line, of the Sibley Memorial Highway
produced to intersect the said right -of -way
line, thence South along the center of the
said Sibley Highway 700 feet to a point 345
feet north of the south line of said N. E.
thence East 325 feet to the point of beginning,
containing 3.82 acres;"
(c) Section 8.1 is amended to read as follows:
118.1 DESCRIPTION OF LANDS. Only the following
described land and those lands classified SC,
Shopping Center District by subsequent rezoning
under Article XIV shall be classified as SC,
Shopping Center District.
(1) The northerly 998 feet of that part of the
West 2 of the East z of the Northwest 1 of the
Southwest u of Section 25, Township 28 N.,
Range 23 W. and the West 2 of the Northwest
of the Southwest 1 of Section 25, Township A
N., Range 23 W. lying South of State Trunk
Highway #100 and East and Southeast of State
Trunk Highway #49, also known as State Trunk
Highway #88, as said highways are presently
laid out and West of the new right -of -way
line of State Trunk Highway #49, except that
part thereof described as follows: Beginning
at a point on the Easterly side of the right -
of -way line of State Trunk Highway #49, also
known as State Trunk Highway #88, as presently
constituted, at which point the Easterly
boundary of the West z of the Northwest 4 of
the Southwest 1, Section 25, Township 28 N.,
Range 23 W. intersects the said Trunk Highway
#49 and thence in a Southwesterly direction
along the right -of -way line along said Trunk
Highway #49 adistance of 150 feet; thence in
a Southeasterly direction at right angles a
distance of 150 feet; thence in a Northeasterly
direction at right angles.a distance of 150
feet and thence in a Northwesterly direction
at right angles a distance of approximately
150 feet to the point of beginning.

{II) This ordinance shall take effect and be enforced from
and after its passage and publication.
Enacted and ordained into an ordinance this 24th day
of June 1958,
