AMENDMENT TO NUISANCE ORDINANCE
AN ORDINANCE AMENDING
AN ORDINANCE defining nuisances, prohibiting their
creation „or maintenance and providing a penalty for
violation thereof.
The Village Council of Mendota Heights ordains as follows:
(1) Ordinance No. g'e� being an ordinance defining nuisances
and prohibiting their creation or maintenance enacted
Tpv 19 , and published
is hereby amended in the following respects:
(A) Section 4 is hereby amended by adding thereto a new
subdivision 16 reading as follows:
j "16 The permitting of running at large within the
Village of any dog:
(a) which is vicious, dangerous, ferocious, or sick
with or liable to communicate hydrophobia or
infectious diseases;
(b) which disturbs the peace and quiet of the Vil-
lage by barking, making other large or unusual
noises or by running through or across cultivated
gardens or fields."
(B) Section 'V is amended to read as follows:
Section V. Penalty. Any person, firm or corporation
who shall knowingly cause or create a nuisance, or per-
mit any nuisance to be created or placed upon or to
remain upon any premises owned or occupied by him or
them, or, in the case of the owner of a dog, who
shall permit a dog who is a nuisance as herein defined
to run at large within the Village, shall upon convic-
tion thereof be deemed guilty of a misdemeanor, and
shall be punished by a fine of not less than five dol-
lars ($500) nor more than one hundred dollars ($100.00)
and costs, or by imprisonment for not less than five
days nor more than ninety days; provided, that in event
of failure to pay any fine or costs assessed upon any
person he may be confined an additional number of days
equal to the number of dollars of fine and costs assessed-
in the case not to exceed three months.
(2) This ordinance shall take effect and be in force from and after
its passage and publication.
