Res 2006- 10 Approving Wetlands Permit @ 1280 Lakeland AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06 -10 A RESOLUTION APPROVING A WETLANDS PERMIT 0 of I "JAIN M I am VIA )z &-*-12104 py 0 03 Uffly L3 I 10 1 kyj t 0 Lyj 5 U Rj F., 10 Lai RMWIM014 THE EXISTING WETLAND AT 1280 LAKEVIEW AVENUE WHEREAS, Mr. Don Mittelstaedt has applied for a Wetlands Permit for a New Home at 1280 Lakeview Avenue [Lot 1, Block 5 Furlong Addition, Dakota County, Minnesota, According to the Recorded Plat; Pin #27 - 28400- 010 -05] as proposed in Planning Case #06 -01; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 31, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for a new home as presented to the Planning Commission on the evening of January 31, 2006 and as shown in Planning Case #06 -01; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for a new home to encroach no further wetland at 1280 Lakeview Avenue as proposed in Planning Case #06 -01 is hereby approved on the following conditions: 1. The Code Enforcement Officer shall verify that the proposed house meets the City's height regulations for a single - family home in the R -1 zone. 2. Erosion control measures shall be implemented during home demolition and reconstruction activities as recommended by the City Engineer. 3. A 25 -foot natural vegetation buffer shall be provided along the edge of the wetland for filtering and to minimize erosion in the long term. The applicant shall submit a detailed landscape plan to City Staff for review and approval. 4. The existing septic system shall be properly abandoned and the new home shall be connected to City sewer and water. 5. The new home shall be constructed with the required aircraft noise attenuation as specified in the City's Aircraft Noise Attenuation Ordinance. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby snakes the following Findings of Fact: 1. The proposed home will encroach no further into the wetland setback than 25 feet for a minimum distance of 75 feet from the existing wetland. 2. No existing vegetation removal will occur since the improvements on the site are being constructed in the location of previous buildings. 3. The application adequately protects the wetland water quality, and is consistent with the intent of the Wetlands Ordinance. BE IT FURTHER RESOLVED that the Wetlands Permit for a New Home for 1280 Lakeview Avenue as proposed in Planning Case #06-01 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
