Res 2006- 19 Approving Wetlands Permit @ 796 Havenview CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-19 A RESOLUTION APPROVING A WETLANDS PERMIT FOR RESTORATION OF SHORELINE AND REAR YARD AT 796 HAVENVIEW COURT WHEREAS, Mr. Richard E. Nelson has applied for a Wetlands Permit for Restoration of Shoreline and Rear Yard at 796 Havenview Court [Lot 2, Block 2 Bridgeview Shores 3rd Addition, PID: 27-15152-020-02] as proposed in Planning Case #06-04; and WHEREAS, The Plaraiing Commission held a public hearing on this application at their regular meeting on February 28, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for Restoration of Shoreline and Rear Yard as presented to the Planning Commission on the evening of February 28, 2006 and as shown in Planning Case #06-04; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for Restoration of Shoreline and Rear on the following conditions: (1) The applicant shall maintain the proposed native grasses and wildflowers to control growth and other adverse effects on newly emerging native species and shall monitor proposed native grasses and wildflowers for persistent weed problems. (2) The applicant shall commence the restoration project as described in this Wetlands Permit application no later than July 1, 2006 and shall complete the restoration project no later than September 30, 2006. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1 The proposed project will restore the shoreline and eroded areas adjacent to the wetland and have no adverse effect on the wetland. 2. The application adequately protects the wetland water quality, and is consistent with the intent of the Wetlands Ordinance. BE IT FURTHER RESOLVED that the Wetlands Permit for Restoration of Shoreline and Rear Yard for 796 Havenview Court as proposed in Planning Case #06-04 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
