Res 2006- 29 Approving Variance @ 660 Brookside LnCITY OF M[ENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06 -29 A RESOLUTION APPROVING A 12 -FOOT FRONT YARD SETBACK VARIANCE FOR A GARAGE ADDITION AT 660 BROOKSIDE LANE WHEREAS, Mr. Phillip H. True has applied for a Front Yard Setback Variance for a Garage Addition at 660 Brookside Lane [Smith T. T. Subdivision No. 3, Lots 1 &2, PIN: 27- 69702- 020 -05] as proposed in Planning Case #06 -06; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 28, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the 12 -Foot Front Yard Setback Variance for a Garage Addition as presented to the Planning Commission on the evening of March 28, 2006 and as shown in Planning Case #06 -06; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a 12 -Foot Front Yard Setback Variance for a Garage Addition at 660 Brookside Lane as proposed in Planning Case #06 -06 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council 1. The variance is necessary in order to put the property to reasonable use. Expansion of the home to the north would necessitate the loss of a bedroom. 2. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the requested variance. The topography of the property prohibits expansion to the west of the house. 3. Approval of the requested variance will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the 12 -Foot Front Yard Setback Variance for a Garage Addition for 660 Brookside Lane as proposed in Planning Case #06 -06 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
