Res 2006- 30 Approving CUP @1897 Delaware AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-30 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR FILL AND VARIANCE FOR ACCESSORY STRUCTURES AT HENRY SIBLEY HIGH SCHOOL, 1897 DELAWARE AVENUE WHEREAS, Mr. Glen A. Heino of Wold Architects and Engineers has applied for a Conditional Use Permit for Fill and Variance for Accessory Structures at 1897 Delaware Avenue [See attached legal description.] as proposed in Planning Case #06-07; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 28, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for Fill and Variance for Accessory Structures as presented to the Planning Commission on the evening of March 28, 2006 and as shown in Planning Case #06-07; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for Fill and Variance for Accessory Structures at 1897 Delaware Avenue as proposed in Planning Case #06-07 is hereby approved on the following conditions: 1. The applicant shall revise plans to show an additional four (4) deciduous trees within the site. 2. The applicant shall provide detailed plans of all light fixtures within the site. 3. The grading, drainage and erosion control plans are subject to the review and approval of the City Engineer. 4. The one-year time limit for building permits is hereby extended to a total of three years, on the condition that the applicant provide an annual update to the Council on the progress of the project. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed project will improve the overall site area by re-grading portions of the parking lot and improve pedestrian maneuverability within the site area. 2. The combined square footage of all accessory structures within the site will be reduced. 3. With conditions as noted, the proposed accessory building will not create conflicts with the existing building or operation of the existing site. 4. The proposed accessory building meets all zoning ordinance standards for setback, height, and other regulations. 5. The accessory buildings contribute to reasonable use of the property as a school site, based on the use and the size of the property. 6. The variance is necessary in order to put the property to reasonable use. 7. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the requested variance. 8. Approval of the requested variance will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the Conditional Use Permit for Fill and Variance for Accessory Structures for 1897 Delaware Avenue as proposed in Planning Case #06-07 would not have an adverse impact on the health, safety, and general welfare the general purpose and intent of the Zoning Ordinance.
