Res 2006- 44 Approving CUP @ 2218 Lexington Ave SCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-44 , A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE AT 2218 LEXINGTON AVENUE SOUTH WHEREAS, Mr. Thomas R. Wohlers has applied for a Conditional Use Permit for an Accessory Structure at 2218 Lexington Avenue South [South 100 Feet of North 200 Feet of Lot 5 Carolines Lakeview] as proposed in Planning Case #06-16; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 23, 2006; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for an Accessory Structure as presented to the Planning Commission on the evening of May 23, 2006 and as shown in Planning Case #06-16; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for an Accessory Structure at 2218 Lexington Avenue South as pro-posed in Planning Case #06-16 is hereby approved on the following conditions: 1. The existing building shall be modified with proper building permits, removing the garage door and meeting all recommendations of the Building Inspector. 2. The proposed attached garage shall match the principal building in color. 3. The existing building shall not be utilized for the parking of motor vehicles. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The building is located on a parcel of significant size, and will not encroach on neighboring property. 2. The accessory building will be modified to preclude its use as a garage, consistent with zoning regulations. 3. The accessory building meets all other zoning regulations with regard to location and size. BE IT FURTHER RESOLVED that the Conditional Use Permit for an Accessory Structure for 2218 Lexington Avenue South as proposed in Planning Case #06-16 would not have an adverse impact on the health, safety, and general welfare of the citizens of the conununity and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
