A RESOLUTION APPROVING A CRITICAL AREA PERMIT
FOR FENCING AND A FREE-STANDING ADDRESS NUMBER SIGN
AT 1666 MAYFIELD HEIGHTS ROAD
WHEREAS, Mr. Ronald W. Buelow has applied for a Critical Area Permit for
Fencing and a Free-Standing Address Number Sign at 1666 Mayfield Heights Road [See
attached legal description] as proposed in Planning Case #06-17; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on May 23, 2006; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Critical Area Permit for Fencing and a Free-Standing Address Number Sign
as presented to the Planning Commission on the evening of May 23, 2006 and as shown
in Planning Case #06-17;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Critical Area Permit for Fencing and a Free-Standing
Address Number Sign at 1666 Mayfield Heights Road as proposed in Planning Case #06-
17 is hereby approved on the following conditions:
1. The applicant shall submit detailed elevations for the address marker, indicating the
number of surfaces and proposed materials.
2. The applicant shall submit details on style and color of the proposed fence.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The Critical Area Ordinance is intended to provide for protection of the
Mississippi River area with regard to erosion, vegetation, land use, and visual
impacts, among others.
2. The proposed fence and address signing are, upon verification through
additional documents supplied by the applicant, consistent with the City's
zoning and Critical Area Ordinance requirements and standards.
3. The proposed fence and address signing do not result in grading or drainage
alterations, or in the removal of vegetation.
4. The proposed fence and address signing will not have negative impacts on the
Critical Area.
BE IT FURTHER RESOLVED that the Critical Area Permit for Fencing and a
Free-Standing Address Number Sign for 1666 Mayfield Heights Road as proposed in
Planning Case #06-17 would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
