Res 2006- 55 Approving Permits for Summit of Mendota HeightsCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 06-55' A RESOLUTION APPROVING A MINOR PUD AMENDMENT, FINAL PLAT (SUMMIT OF MENDOTA HEIGHTS 2ND ADDITION), CONDITIONAL USE PERMIT, AND CRITICAL AREA PERMIT FOR A THE SUMMIT OF MENDOTA HEIGHTS WHEREAS, Mr. Thomas Becker, on behalf of OPUS Northwest, LLC, has applied for a Minor PUD Amendment, Final Plat, Conditional Use Permit, and Critical Area Permit for a the Summit of Mendota Heights [see attached legal description] as proposed in Planning Case #06-19; and WHEREAS, the City Council, at their regular meeting on June 29, 2005 approved an application from OPUS for a Planned Unit Development and Final Plat for the Summit of Mendota Heights (Planning Case #05-08), NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Minor PUD Amendment, Final Plat (Summit of Mendota Heights 2nd Addition), Conditional Use Permit, Variance and Critical Area Permit as proposed in Planning Case #06-19 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the The proposed plat does not affect the density or essential character of the development nor of the PUD approvals granted to the original project. 2. Highway 13 carries a significant amount of traffic, creating a potential negative impact to the residential units along the roadway. 3. The proposed fence will help to mitigate the potential negative impacts, and will be consistent with the original quality of design and materials used in the development. 4. The proposed sign locations are consistent with the original quality of design and materials used in the development. 5. The changes to the project do not impact the Critical Area, physically or visually, and appear to be consistent with the intent of the Critical Area Ordinance. BE IT FURTHER RESOLVED that the Minor PUD Amendment, Final Plat, Conditional Use Permit, and Critical Area Permit for the Summit of Mendota Heights as proposed in Planning Case #06-19 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
